Melton being of sound mind but in great bodily affliction do make this as my last will and testament. I give and bequeth during the term of her natural life to my beloved wife the following described pieces of land for her full use and benefit with the exception of ten (10) acres hereafter described viz- The east half of the southwest quarter of section thirteen (13) Township Twenty-six (26) Range Twentyone (21) West containing eighty acres (80) also Ten (10) acres to be taken from the west side to run straight through South & South of the SouthWest quarter if the S.E. quarter of Section Thirteen (13) Township (26) Range (21), also Ten (10) acres on the South side to run straight through the forty acres east and west of the S.E. quarter of the South West quarter of Section (13) Thirteen Township (26) Twenty six Range (21) also Twenty (20) acres of the west side west half of the SW of the South W quarter of SE quarter of Section (13) in Town 26 Range (21) also (2 1/2) and a half acres to be in a square in the SW corner of the SW quarter of NE quarter of section (13) Town (26) Range (21) and the NE quarter of the North W quarter of section (24) twenty four and two and a half acres (202 1/2) more or less also another to viz The East half of the SW quarter of SE qr of section Thirteen (13) Township (26) Range (21) containing twenty acres (20) also thirty (30) acres of the North side of the SE qr. of the NW qr. of sect (13) thirteen Town (26) Range (21) by running a straight line E & W through forty acres also seven and a half 7 1/2 acres of the SW qr. of NE qr. of sect (13) Town (26) Range (21) on the West side of said quarter the boundry line of the above is to be a continuation of the division line between Thomas Hanks and Nancy Wall NE S of said Hanks N boundry line leaving said Hanks about thirty (30) acres of said Block containing in all about two hundred and sixty acres (260) be the same more or less.       This estate I bequeath to my wife Margaret Melton during her life at her death to be equally divided between William Henderson Melton, Green Berry Melton & Stephen Decator Melton my youngest sons with the exception of ten acres lying due west of a thirty acre lot taken from the E & N side of the SW qr. of NE qr. of sect. thirteen (13) Town (26) Range 20 the same lying due N of Mrs Walls 30 acres block this I bequeath at the death of my wife to my Eldest son Rueben Melton or heirs or assigns. I also give & bequeath to James M. Davis the following described Parcels (sic) of land viz: The West half of NE qr of Section (11) Town (25) Range (22) THe west half of the above described tract containing forty acres and the SW qr of the SE qr of section (21) Township (25) Range 22 and the NW qr of the NW qr of section (14) Town (25) Range (22) and the NE of the NE qr. of Sect (15) Town (25) Range (22) the south forty acres of the above described tract to have and to hold forever and he can also have the use and benefit of the cleared land for the space of three years in above tract. I also give to my daughter Diana Isabell Melton the east half of the NE qr of sect (11) Town (25) Range (22) containing forty acres and the forty acres North of the last described south forty given to Jas Davis. I also give & bequeath to John E. Smith the remaining forty acres of the above described (200) acres of land I give and bequeath to Robert Meadows My entire interest consisting of four tenths 4/10 of the estate of Ruben & Ailsy Melton Decd.. I also give to Ruben Melton my son the lands named in the deed made by Thomas Hanks to me on the 29 of October 1863, containing one hundred and ten acres (110). I also give of the following Personal Property consisting of 12 hoses recognised by my wife as the property of my children and the remainder to be disposed at the discretion of my wife.       Given as my free act and will on this the first day of August in the year of our lord eighteen hundred adn seventy. Recorded in Book no. 4, pgs. 137-139. Appraisers: E.H. Cornog, Ephraim Wray, William Baine. Total value of appraised property was ,565.00. Other accounts, notes, money etc, totaled 4.88. They swore on oath to above Sept. 17, 1870 before Jacob M. Melton Thomas J. Gideon, Clerk of Circuit Court certifies that the Will was filed on 26th day of September 1870, and recorded in book No. 4, p. 137 to 8 and 9. Signed Thomas J. Gideon, clerk Missouri\ County of Christian\       In view of the Probate Court be it Remembered that on this 23rd date of August 1870. Personally appear before the undersigned Probate Clerk of the Probate Court of Christian County, and state aforesaid, J. C. Bertier and Thomas Hanks the subscribing Witnesses to the annexed will of Martin F. Melton and being by me find duly sworn the said J. C. Bertear the poses and says that he signed the name Martin F. Melton the testator or to the annexed will viz by his discretion at his request and in his presents in that the said J. C. Bertier and Thomas Hanks deposes and says that the said Martin F. Melton the testator Produced the said Will and instrument of writing and in their presents declared the said instrument of writing to be his act and publish the same as his last Will that he the said testator was at the time of publishing his said Will of sound mind and more than twenty one years of age and that the said deponents all said the said Will is witnessed thereto by subscribing their names to the same in the presence of the said testator.                               J.C.
