:Joseph came from Fishkill, New York to escape persecution in the USA for being loyal to the British in the 1790's. He moved to Smithville, Ontario in 1793. Canadian branch of Merritt’s traces its genealogy on this continent to Henry Merritt, who among other puritan refugees, sought religious freedom when he came from England to the New England colony in 1626.[1]
He may be the Joseph Merritt that In 1787 was forgiven for all past and future quit-rent on 100 acres on lot 1 of the Queensbury Patent on account of the American Revolution.[2]

I Joseph Merritt of theTownship of Grimsby in the County of Lincoln and District of Niagara...do make & ordain this my Last Will and Testament; that is to sayprincipally and first of all I give and Recommend my Soul into the Handsof Almighty (sic) God that gave me life and my body I recommend to theEarth to be buried in a Decent Christian Manner at the Discretion of myExecutors And... as Touching Such Worldly Estate Wherewith it hathpledged God to Bless me in this Life I give Demise...in the followingmanner. Viz. First... just Debts to be paid punctually Secondary I giveunto my beloved wife Mary Merritt all my Household furniture one Cow andone Horse to ride. During her remaining my Widow also I give unto my twosons Elijah & Daniel Merritt my farm whereon I now live being in theTownship of Grimsby, that is to say Elijah to have the North End andDaniel the South End. Also I give unto my Frand Son David Merritt theSum of pounds to be paid at the Discretion of my Executors after my SonDaniel comes of age of Twenty one years of age the Stock to be Sold andEqually Divided between my three sons Namely Moses, Isaac & JosephMerritt. I also appoint my three sons Elijah, Joseph, & Daniel Merrittmy sole Executors of this my last will and Testament... & have hereuntoset my hand and seal this eighteenth day of February Eighteen Hundred &thirteen.

BIOGRAPHY: [1]Joseph died on 26 February, nearly a week following thewriting of his Will and was buried in the cemetery which had beenrecently begun on his property. The inscription on his stone in theMerritt Settlement Cemetery reads: "Joseph Merritt/died/Feb 26 1813.../AE71 yrs 1mo/& 7 d's." His wife Mary followed him two decades later."Mary/wife of / Joseph Merritt/died/ Nov 24 1834/ Ae 83 yrs 7mo/ & 1 day."
