Biography

John Merritt wasn't the eldest brother, thus didn't inherit any of his father's lands, which instead passed on to a nephew. However he became the eldest living brother by about 1738. He was industrious, buying and selling several properties north of Mount Landing Creek, before finally settling on land within the Padgett patent on the south side of said creek. He was active in the county courts. He would eventually lose his land to debt during the epidemics of the 1760s, and it seems that his surviving descendants will leave Essex County by that time.

Children of John Merritt

While no records exist that simply spell out this family, there are plenty of fragments that provide hints. So who are John's children? I suggest the following, and these are likely only just a few. The John of this page had a long life and more children will likely connect to him over time as the work continues.

John Merritt, who I believe is the John JR who actually appears in a record with the John of this page. Most likely the eldest brother.

Thomas Merritt. Never appears in a record with John, but certainly in tons of records of everybody he knew.

Because John was living where he was when the following Essex men were born there, these following men I suggest go to him as well. Absolute proof will come with further work and descendant dna testing:

Tapley Merritt.

Major Merritt.

A descendant of this family called the men of this era the "Fighting Merritts". That helps to tie the above four war veterans together. [1]

There are likely more, both sons and daughters to include: Archelaus and William Merritt, who returned to Essex VA after the Revolution [2], and likely Margarit Merritt who appears in several Essex order book entries during the 1760s (see will of January 1761).

Waring's Mill location, St. Anne's Parish

John's records can be grouped into two locations depending on where he lived. The first location is that of current Waring's Mill, located where Route 716 crossed Mount Landing Creek in Essex Virginia. John lived adjacent and on the north/north east side, and owned the mill at one point. Waring's Mill appears variously in the records as Jones, Gouldmans, Pleas, etc. The earliest name if have found for it is Gilson's Mill Pond, as it appears in the 1600s. Any of John's records from St. Anne's Parish are from when he lived at this site.

John seems to be a neighbor and friend of William Carroll. (Carnal, Karnal, etc)

    • At a Court held for Essex County at Tappa. on the 18th day of Feb 1734 John Merritt presented this Lease and Release Indented from Garrett Bourn deced to him praying it might be proved & admitted to record WHICH WAS APPOSED by WILLIAM BEVERLEY gent Attorney for JOHN WILCOX gent because the sd John Wilcox had a Subsequent deed acknowledged and recorded … in possession thereof having obtained a judgement in the General Court for the same, which was OVERRULED by the Court and thereupon James Merritt & Robert Hamilton being sworn declared that they did see the sd Garrett Bourn in his lifetime sign Seal & deliver this Release as his act & deed which on the motion of sd John Merritt was admitted to record.

  • 21 Jun 1737: At a Court held for Essex County at Tappa. on the 21st day of Jun 1737. JOHN MERRITT acknowledged this Indenture to Thomas Waring gent to be his act and deed and the ANN the WIFE of sd JOHN freely relinquished her right of Dower in the land conveyed by this deed which on his motion is recorded[16]
  • 17 May 1738: Martha Hendrick is sued by John Merritt over the estate of James Merritt who died by 1733. [17]

The below witnessing leads to speculation that John married Ann Convington:

  • 16 Oct 1742. I RICHARD COVINGTON of the County of Essex and Parish of St. Anns for the Natural love I have and bear unto my loving Daughter after my own Natural life and bequeath unto my said Loving Daughter ANN COVINGTON all my Estate that I am now preset with both Royall and personall to her and her heirs forever after my own Natural Life meaning my land whereon I now live and all my Negroes [4 named] and all my stock of hogs, cattle and sheep and whereof I have set my hand and seal this 16th day of Oct 1742. RICHD. COVINGTON. Wit: Benja. Winslow, Frans. Gouldman, John Price, Wm. Carroll, JOHN MERRITT. At a Court continued and held for Essex County the 17th day of Nov 1742. Benjamin Winslow Gent and William Carroll made oath that they did see Richard Covington sign and deliver this Indented Deed of Gift to his Daughter ANN COVINGTON and also that they did see FRANCIS GOULDMAN, John Price and JOHN MERRITT at the same time Subscribe their names as Witnesses thereto and then the said Deed was admitted to record.[18]

The below record provides us with a snapshot of the living siblings between 1738 and 1742.

  • 23 Aug 1742: James and Martha Parker Merritt had no issue from their marriage. From Bob Baird: "For instance, the 23 August 1742 accounting of his estate by Robert Hudgens included payments to John and Francis Merrit and Mary Cox for their part of their brother James Merrit's estate which came into the hands and possession of William Hendrick. Other accounting by Robert Hudgens identify James Merrit as the first husband of Martha (Hendrick) Hudgens. Robert Hudgens and his wife Martha were also involved in the final settlement of Merritt's estate. The inventory and appraisal of Merritt's estate was made in January 1734 in Caroline and Essex counties and was recorded in Essex County on 21 July 1736." [19]

Padgett patent land, South Farnham Parish

John's records can be grouped into two locations depending on where he lived. The second location is on the 20 Sep 1666 patent of Edmond Padgett and Wm Sergant. This is located adjancent to Mount Landing Creek on the south side, a little southwest of Waring's Mill above. Now in South Farnham Parish, John would live the remainder of his life here, still in walking distance of Waring's Mill.

  • 16 May 1743: HENRY ROBINSON of the County of Essex, Gent., for the sum of Five Shillings current money of Virginia hath granted unto JOHN MERRITT of the same County, Planter, one tract of land being in the Parish of SOUTHFARNHAM in the County aforesaid containing 200 acres, it being the Land that he the said Henry Robinson purchased of FRANCIS PAGETT by Deed bearing date the 13th day of October 1740 … Also one other tract of Land containing 30 acres scituate and being in the Parish and County aforesaid, and bounded by the aforesd. 200 acres and the Land of ROBT. BROOKING, And all houses buildings, orchards and appurtenances … granted for and during the full term and time of one whole year from thence and fully to be completed, paying therefore the rent of one ear of Indian Corn on Lady Day next if the same shall be lawfully demanded … the sd JOHN MERRITT may be in actual possession of the premisses and be thereby enabled to accept and take a grant and release of the reversion thereof …. Signed: H. Robinson Wit: Alexander Parker, Fras: Smith[20]

A classic mistake made by researchers of this family is to take the 30 acres mentioned in the above deed, (South Farnham Parish) and confuse it with the 30 acres inhereted by John's brother Joseph (St. Annes Parish) then jump to the conclusion that John inherited this land from Joseph, thus making him the son of Joseph. I still see family trees with this mistaken connection.

"..and for expenses at Caroline Court at the sale of the Negroes, for a copy of John Munday's Will.. for going to the falls of James River after debts, for expenses at Westmoreland Court..." [21]
  • 1745: Will of Henry Pagett of the County of Essex and Parish of South Farnham, ...leave my whole estate to my well beloved wife Marget Pagitt. William Walkins and John Check, Jr. of the County of King and Queen shall be executors. Signed, Henry (HP) Pagett. Wit: John (P) Pagett, Jr., John Merritt.[22]

  • 18 Mar 1746: Bond of John Merritt as administrator of Duncan Graunt. For L550 current money. 18 Mar 1746 (1747). Security, Henry Crittenden. Signed: John Merritt, Henry Crittenden, Robert Gresham (Gressom). [24]
  • 20 May 1746: This Indenture made the 20th day of May in the year of Our Lord 1746, between John Merritt and Ann his wife of the County of Essex, Planter of the one part and John Fantleroy in the County of Richmond...10 1bs current money..to the said John Merritt...paid by the said John Fantleroy...he the said John Merritt hath granted, bargained, sold...unto the said John Fantleroy...by virtue of a bargain and sale to him thereof made by the said John Merritt for one whole year by indenture bearing the date, the day next before the day of the date of these presents..and his heirs forever, one tract of land situate..in the Parish of South Farnham in the County of Essex containing..200 acres..it being the land that the said Merritt purchased of Henry Robinson by deeds of leave and releave bearing the date of the 16th and 17th days of May in the year of our Lord 1743, ..also one other tract of land containing thirty acres..lying in the Parish and County aforesaid and bounded by the aforesaid 200 acres of land and of Robert Brooking in the said 30 acres also being conveyed to the said Merritt by the said Henry Robinson and all houses, buildings, ...To Have and to Hold the said two tracts of land...and the said John Merritt..doth covenant promise and grant..that the said John Merritt, now at the time of sealing and delivery of these presents is seized of a good, sure perfect and indispensable estate of Inheritance in fee simple and...in the premises hereby granted and released..and that the hath good power and lawful and absolute authority to grant and covey the same to the said John Fantleroy. /s/ John Merritt, Ann (A) Merritt.. Wit: Nicholas Sason, W. Watkins, Wm. Threshly. John Merritt received 110 pounds.[25]
  • 16 June 1747: Robt Brooking and Frances his wife of King and Queen Co sell Robt Gresham of Essex Co, for L90.18.9, 505 acres in So. Farnham Parish. Adjoins land of Henry Crittenden [shown here as Crittendom], John Merritt, the Roaring Run, Mr. Francis Smith, Mr Fantleroy, Mr Sullivans Gillsons Swamp, Sil Tandy. Recorded in King and Queen County[26]
  • 11 Jan 1748. Indicates that JOHN MERRITT and his wife ANN were friends of ROBERT GRISSOM dec’d.[27]
  • 15 Jul 1751. JOHN MERRITT and Wm. WATKINS were witnesses to Deed, Richard Gatewood to William Gatewood 100 acres, part in Essex on Branches of HOSKIN’s Creek and part in King and Queen on Branches of TUCAHO SWAMP.[28]
  • 1761: Edmond Pagget was given 50L for being a witness re John Merritt in 1761. [29]
  • Margaritt Padgett’s will of January 1761. Remains of estate given to Martha Padgett. Witnessed by Walter Ferrill, James Pagett, John Merritt Jun, and John Merritt.[30]
  • 13 Oct 1762: This Indenture made the 13th day of October..1762 between John Merritt of the county of Essex, Planter of the one part and James Ritchie and Company of Glasgow, North Brittain, Merchants of the other part. Witnesseth: That the said John Merritt, for and in consideration of 60 pounds current money…NOW DUE FROM THE SAID JOHN MERRITT TO THE SAID JAMES RITCHIE…and for which the said John Merritt sometime ago gave bond, hath granted, bargained…3 mares and 2 colts, one horse, six head of cattle, one still and three beds with furniture..to have and to hold..provided nevertheless that the said John Merritt shall pay or cause to be paid to the said James Ritche and Co. the said sixty pounds with lawful interest.. then this indenture do be void. And the said John Merritt..to deliver up the said 3 horses, etc..to be sold to the highest bidder if he the said John Merritt shall fail to pay the said debt with interesting a reasonable time…Signed, John Merritt. Wit: Andrew Crawford, Neil McCoull, Robert Ferguson. (John Merritt evidentally mortagaged his land, then when he was unable to pay, he also mortgaged his cattle, horses, etc. – L.S. Turner) [31]
  • 11 Oct 1763: Thomas Gressom of Amherst County Appoints John Merritt of Essex Co, South Farnham Parish, his lawful attorney. A letter of Attorney from Thomas Gressom to John Merritt was proved.[32]
  • 17 Oct 1763: On 17 October 1763, Thomas Merritt received from Thomas Gressom (as did John Merritt) Power of Attorney. Gressom hired Thomas Merritt to be his attorney as he, Gressom was living in Amherst county, Virginia at that time. Thomas Gressom was on a deed with John Merritt when the land was sold by Archibald Ritchie in Essex County.[33]
  • 21 Mar 1765: March the 21st, 1765, the subscriber bought a tract of land, lying in the county of Essex, and parish of South Farnham, from Thomas Grissome and John Merrit, for a valuable consideration, containing 505 acres to which deed there are four witnesses, two of which have been out of the colony for a considerable time, which prevents the said deed being fully proved; the 18th of May last it was proved in Essex court, by the other two witnesses now here. Under these circumstances, I am advised to take this method to forewarn all persons from making a purchase of the aforesaid land from either Thomas Grisome or John Merrit, without the approbation of Archibald Ritchie [34]
  • 20 Jul 1772: To be Sold, on the premises, on Friday the 13 of August, A Tract of Land, lying in Essex county, containing about 500 acres, whereon Mr. John Merritt now lives. This land was conveyed by Thomas Grissam and the said Merritt to the subscriber (of which the public has heretofore been advertised in the Virginia Gazette) and has lately been recovered in the court of the aforesaid county. Six months credit will be allowed, on giving bond and good security to the subscriber, who undertakes to put the purchaser in possession. Archibald Ritchie. [35]

While John Merritt bought and sold land and witnessed many records in South Farnham Parish, it was actually a mystery as to where he actually lived. We knew he eventually lost his land but not where it was. After decades we we finally find out where John had been living. Once we found the following 1774 deed, we were able to back track and figure out where/when John Merritt got his last property:

  • 23 Apr 1774. Deed. Archibald Ritchie of South Farnham Parish, Essex County, Gentleman, for 18 pounds 15 shillings, sold to Christopher Barbee South Farnham Parish, Essex County, a 30 acre parcel of land in the said parish bounded by Fauntleroy's line, said Barbee's land, and Roaring Run, it being the land which the said Archibald Ritchie recovered against John Merritt by ejectment in the County Court of Essex on 22 June last. Acknowledged 16 May 1774 and admitted to record. [36]

    • 24 Apr 1669, Edmond Pagitt for 2,200 pounds of tobacco sold to Thomas Gouldman 200 acres lying on Mr. Gibsons Creek on the Southside thereof, it being parte of a patent of 707 acres. Signed Edmund Pagitt. Witnesses: Theophilus Weale, Tho: Yates. Recorded 5 May 1669.[37]
    • 30 Aug 1670, Edmond Pagill [sic] for 3,000 pounds of tobacco sold one moyety of land unto John Meguffie. The land bordered that of Theophilus Veale. Edmond had “hereunto Sett my hand and seale together with Elizabeth my wife”. Signed Edmond Pagill [sic]. Witnesses: Tho. Gouldman, John his B m Bowry. Recorded 7 September 1670.
    • In November of 1672 Thomas Gouldman also decided to sell to John Meguffie "a moeyte of land with thirty acres [more or less] that had also been a part of Edmund and Serjeants patent." Beginning at a Beech and oak tree standing in a swamp that parts this land with Thomas Thomlin's land running along the same swamp until you come to a marked Beech standing in the same swamp, thence up another swamp to a marked persimmon tree and along the brink of the said swamp to two white oaks growing on one root thence to another white oak and poplar, thence to a maple tree until you meet with a corner tree standing near the first mentioned or near John Meguffie's cornfield fence. "
    • August 17, 1742. John MeGuffee sells to Robert Brooking 30 acres more or less that he purchased of Thomas Gouldman 1 November, 1672. John Merritt must aquire it between this and the next record.
    • 25 Jan 1743: Processioning places Merritt at this location.
    • 16 June 1747 deed from Robt Brooking and Frances his wife of King and Queen Co to Robt Gresham of Essex Co lists John is an adjacent property owner. Gresham's new land is basically the western half of Edmund Padget's old patent and indicates that John Merritt is living dead center of the patent, adjacent to the Padgett family descendants on his east.
