This implies Charles' land had already been divided among his heirs before 1833; probably in 1816 with his estate settlement. Why was there not a Deed until 1833? Is it because his wife Sarah was still living?

In the name of God Amen, I Sarah Winstead of the County of Person and State of North Carolina being of perfect mind and memory do make and ordain this my last Will and testament In manner and form following that is to say. - principally and first of all I command my soul into the hands of God who gave it, and my body to be buried in a decent and Christian like manour at the discretion of my Executor to be hereafter named. And as to the worldly estate with which it hath pleased God to bless me in this life I give desire and dispose of in the following manner.
Item 1st - I give to Barnett Winstead my son one bed and furniture and one ewe and lamb to have and to hold forever.
2nd - I give to Nelly Winstead my daughter one chest and five dollars to have and to hold forever.
3rd - I give to Sally T Winstead my daughter one Heifer one Trunk, and five dollars to have and to hold forever
4th - I give to Seth M Winstead one Grey Mare which I have heretofore put in his possession and which he has traded off. Also one other grey mare and bay horse colt now in my possession one bed and furniture one cupboard, one folding Table, one Cow & Calf, all my stock of hogs and balance of sheep all my household & kitchen furniture and every species of other property I may possess at my death, and of which he is to pay all of my just debts.
5th - And lastly I do hereby constitute said Seth M. Winstead Executor to this my last Will & Testament, disallowing and disannulling all former Wills by me heretofore made, ratifying this and this alone to be my last Will and Testament, this 25th July 1829.
