In the Name of God, Amen. I, Thompson Newby of Warren County, being weak in body and of a sound mind, do make my last will and testament as followeth: 1st, I give to my beloved wife Mary the plantation whereon I now live, supposed to contain 160a bounded by Warren Fillpott, Rebecca Nancy Gilly, and the Mountain Creek, also stock, equipment and furniture. 2nd,.

I will to my son Thompson Warren Fillpot Newby all of the above described land at the death of my wife Mary. 3rd,. will to my daughter Marthy M , 100 acres. 4th,. will to my daughter Elizabeth 0.00 in property that William B. R. Newby owes me. 5th,. will to my daughter Mary 50 acres, entered in the name of Joseph Graham, the place where she now lives. 6th,. will to my daughter Syrena land, supposed to be 100 acres. 7th,. will to my daughter Syrena, land supposed to be 100 acres (repeat of item 6) 8th,. will to my son William B. R. Newby the tract of land where-upon he now lives. 9th,. will to my daughter Rebecca 100 acres on Mountain Creek, being a one third part of a three hundred acre survey of which Marthy M. and Syrena have the other two thirds.

Whereas Emerson Hill and Margy his wife leaving me security for them and having the same to pay, I do will and declare they are exempt from any part of my estate unless they come forward and make acknowledgement and pay up the said monies. Whaly and Sarah having their part laid off to them and deed been made to their part, they are therefore not considered in this will. I appoint Alex McC. McWherter My executor. Witnesses Wm. B. R. Newby and William Pegg. 1

Thomas Jefferson Hill's first wife was Margaret Ellen Womack (possibly the daughter of Abner??? ) his second wife was Mary Margaret Bethel the daughter of Sampson and Catherine Newby. Thomspon Newby is the father of Catherine Newby.
