John was in a farming partnership with his brothers-in-law Charles, James and, briefly, George Brown, for sometime at Mt Prospect before he selected 236 acres at Summerfield on 28 July, 1871. He increased his holding when James Brown sold him his selection of 213 acres next door in 1876 but he died 3 years later.[1]
This legal notice was in the newspaper in February, 1879:
NOTICE is hereby given, that after the expiration of fourteen days from the publication of this notice, application will be made to the Supreme Court, of the colony of Victoria, in its Probate Jurisdiction, that PROBATE of the LAST WILL and TESTAMENT of JOHN NEWTON, late of Neilborough, in the colony of Victoria, farmer, deceased, may be granted to Robert Newton, of Terrick Terrick, in the said colony, farmer, George Brown, of Neilborough, aforesaid, farmer, and Benjamin Hichborn Fernald, of Kamarooka road, in the said colony, state school teacher, the executors named in and appointed by said will. Dated 21st day of February, 1870. CRABBE and KIRBY, proctors for said executors, Albion chambers, Sandhurst.[2]
