Last Will
Will of Moses Oldham 1861 Quality or Certainty of Data: 3 Data: Text: The State of Texas County of Burleson I Moses Oldham of the county and the state aforesaid being of sound mind and disposing memory but weak in bodily health do make ordain and establish this to be my last Will and Testament. Items 1st I give to each of my following named children the sum of fourteen hundred dollars each. Namely to Polly Tidwell, Ebenezer Oldham, Elizabeth McMurry, Nancy Thorp, Emily Holmes is deceased, Children, Samantha Shields, James T. Oldham, Moses Oldham JR and Eliza A Posey deceased. Children, I give to my son John Oldham the sum of nine hundred dollars. I give to my grandson Milton Oldham the sum of two hundred and fifty dollars. I give to my great granddaughter Mary Harvey the sum of two hundred and fifty dollars and if she should die leaving no children before she attains the age of twenty one years I then give to my grandson Milton Oldham the two hundred fifty dollars herein given to her the said Mary Harvey. I give to my grand daughter Jane Gee the sum of one thousand dollars in money and hereby appoint my son James T Oldham to act as guardian of the said Jane Gee until she arrives at legal age or marries but if she dies before she comes of age or marries, then I wish a legal division of her part amongst all my heirs. I give to my daughter Nancy Thorp the whole six hundred forty acres a tract of land which I own in Johnston County in this state which lies at the mouth of Strouds Creek to be charged to her in making up the legacy of Fourteen Hundred Dollars at value at will. I give to my daughter Polly Tidwell making her Legacy of one thousand dollars in money. I give to my son Ebenezer Oldham a tract of 80 acres of land which I own in the state of Missouri lying and forming the land of my said son, Ebenezer Oldham to be charged to him in making up his Legacy of Fourteen Hundred Dollars at whatever a disinterested man to be selected by the said Ebenezer Oldham may value it at. The legacies herein before given in money are to be made out of my property of whatever kind not herein officially disposed of either by dividing it amongst those to whom legacies are left if it can so be done by selling it and dividing the money in the proportions herein before stated. After the payment of all the legacies herein before provided for, should there be anything left then I direct that the balance left, if any, to be equally divided between my three youngest children namely James T Oldham, Moses Oldham and Eliza A. Posey, decd children and lastly I appoint James T Oldham, my son and my son in law, J P Posey Executors of this my last Will and testament and desire the Probate Court to permit them to qualify without giving bond or security. Posey and Lauday Shoumake, two of the subscribing witnesses , whose name is subscribed for the last will and testament of Moses Oldham, Dec that the said Moses Oldham signed the said Will in their presence and the other subscribing J. I Riley and that the said Moses Oldham stated in all of their presence that the same was his last will and Testament and requested each one of us to subscribe our names as witnesses there to in each others presence and that they did so. Sworn to & subscribed in open court before me this 26th day of August 1861. Thomas Johnston Chief Justice Burleson Co. The State of Texas County of Burleson, I, James T Oldham do solemnly swear that the writing on the reverse which has been offered for probate is the last will of Moses Oldham Dec. so far as I know or believe and that I will and truly perform all the duties of Executor of the said will of the said estate of the said Moses Oldham Dec according to the best of my skill and ability so help me God.
