Biography

John Orchard receives at least two land Patents in Virginia before 1640.

p. 12 – “JOHN ORCHARD, 100 acs. James Citty Co., last day of Sept. 1636, p. 393. Upon the W. side of Chickahominy Riv. at SWAN howes point, N.E. upon sd. Riv. & W. into maine woods. 50 acs. for the per. adv. of his now wife ANN ORCHARD & 50 acs. for trans. of one servt. WILLIAM OXFORD.[1]

p 14 – “JOHN ORCHARD, 350 acs. James Citty Co., 15 Aug 1637, p450. Right against the further Gulfe on the E. side of Chichahominy Riv. a mile from the hether side of Warrany Landing place, W.N.W. upon the river, s. & W. down the riverside for the breadth & E.S.E. into the maine woods. Trans. of his wife ANN, dec’d., his now wife MARY, his owne per. adv. & 4 pers. Transported: WILLIAM OXFORD, JOHN WARD, MARGERY PRICE, FRANCIS MUFFETT.”[2]

John Orchard's wife is named "Ann" in the first Patent. Ann is deceased by the time of the second Patent and his current wife is "Mary".

There are no apparent children by John in any of these marriages.

John apparently sells his second Patent to Henry Filmore:

p. 200 – “Henry Filmer, who settled in Virginia at an earlier date appears to have been an uncle of Samuel Filmer. He was a member of the House of Burgesses for James City county, 1642-3, and a Justice of Warwick where he finally made his home in 1647. He obtained the following grants: (1) Henry Filmore, 1000 acres in the county of James City, on the Chickahominy River, near Warren’s landing, adjoining the land of John White, 350 acres thereof formerly granted to John Orchard, Aug. 15, 1637; 350 acres granted to John White, April 29, 1639, and 300 acres granted to Thos. Stout, April 10, 1639, and by the said Filmore purchased from them, now granted him Feb. 6, 1653.”[3]

Research Notes

Because of the difficulty in finding records for the early period of Williamsburg and the surroundings, many early researchers have conflated John Orchard of James City/Charles City with John Orchard (Orchard-629) the minister of Massachusetts. It is the latter John Orchard who was wed to Anne Phillips.

Also, it is not certain that the John Orchard in this profile is the husband of widow Ann Orchard who wed Henry Tyler (Tyler-414) as his second wife.
