Disputed Origins

The Great Migration Directory, page 250 lists Anthony Paine and indicates his origins are unknown; therefore the names of his parents, the date and location of his birth are not known. Please do not add Ralph Paine and Dorothy (Unknown surname) Paine as the parents of Anthon Paine, or any other parentage combination.[1]

Biography

Anthony Paine was born in England, perhaps in about 1585, estimate based on age 25 years at marriage.

He married, in about 1610, Alice Potter, said to be the sister of Robert Potter. However, based on the year Alice was born, and the year of birth of Robert Potter and each of his siblings, she was likely his aunt, sister of Robert's father George. Terms like sister were often used for an aunt, similar to brother for nephew, etc.

She was the sister of Robert Potter, then of Lynn, Mass., but later of Portsmouth, R.I., where he signed the compact in 1639.[2]

Alice and Anthony had at least four children:

  1. Alice Paine, b. Abt 1612, England, bapt. 30 Aug 1626 at Newport Pagnell, Buckingham, England, father Anthony Paine, FHL Film 88489.[3] m. Lott Strange, who died before 1688, no children; Alice d. 1690. Alice's will of 1688 left legacy to her niece Elizabeth, daughter of John Tripp and her sister Mary.[4]
  2. Mary Paine, b. Abt 1616 (uncertain) in England, m. (1) abt 1638, prob. in Portsmouth, R.I. John Tripp who died at Portsmouth in 1678. Mary (Paine) Tripp m. 4 Apr 1682 at Portsmouth Benjamin Engell. Mary d. 12 Feb. 1687, prob at Portsmouth.[5]
  3. Anne Paine, bapt. 8 Oct 1620: "Anne Payne, the daughter of Anthony Payne and Alice his wife was baptized the 8th day of Octobe 1620." (See image.)[6]
  4. Anthony Paine, bapt. 24 Jul 1631 at Newport Pagnell, Buckingham, England; d. 26 Jan 1632, father Anthony Paine, FHL Film 88489.[7]

Anne and Anthony did not survive. Anthony Paine named daughters Alice and Mary in his will.

Anthony Paine migrated in 1638 and resided in Portsmouth, Rhode Island.[1]He was admitted as an inhabitant of Portsmouth, Rhode Island on 6 Feb 1638:

Feb 6, of the same year, 1638, ANTHONY PAINE was "received to be an inhabitant" at Portsmouth, R.I., but further particulars concerning him, or his family are wanting, except that...his wife bore the sweet name of Rose.[8]

John Anthony and 28 others (John Tripp, Robert Stainton, George Potter, Robert Potter, Wm Hutchinson, Samuel Gorton et al) signed a Compact of Loyalty to the government of Portsmouth on 30 Apr 1639:

We whose names are underwritten, do acknowledge ourselves the legal subjects of His MAJESTY KING CHARLES, and in his name do hereby bind ourselves into a civil body politic, unto his laws according to matters of justice.

Portsmouth Compact
The Portsmouth Compact was signed on Mar 7, 1638. Anne Hutchinson and some of her followers signed the document proclaiming their intention to create a "bodie politick" based on their own principles. Their search for land led them to Roger Williams, who in turn urged them to buy Aquidneck Island from the Narragansett Indians. Now a priceless document held in the Rhode Island state archives, the Portsmouth Compact not only established the Aquidneck Island town, but also set a precedent. It was the first document to establish political and religious independence from England.

A second Compact of Loyalty was written and signed Apr 30, 1639, and included the following names:

Robert Potter, Nathanyell Potter and George Potter Jr. were brothers. They were also Anthony Paine's nephews through his wife Alice (Potter) Paine. They had all been previously driven out of Massachusetts with Ann Hutchinson, Samuell Gorton, the Warners and others, banished for challenging the authority of the leaders of the Massachusetts Bay Colony.

Anthony's first wife Alice died before 10 Nov 1643 — he signed a prenuptial that day with second wife Rose. Anthony Paine, being a widower, entered into an agreement with Rose [French] Grinnell, previous to their marriage. Rose was the widow of Matthew Grinnell whom she married 27 Aug 1615 in Leyden, Essex, England.[citation needed] She deeded to her three sons Matthew, Thomas and Daniel Grinnell "two sheeder goats apiece" and to her son Matthew a cow also. The goats were to abide in the hands of Anthony Paine for three years and the milk to be his, but the increase was to belong to her three sons. It was also agreed between Anthony and Rose that upon the death of either after marriage, the property of the one deceased should go to the children of that person, Rose having four children, Anthony having three.[10]

On 2 Jun 1645 Jun Anthony Paine purchased land in Portsmouth from Randall Holden; witnesses William James, John Warner, John Wilbore.[11]

Anthony Paine's will is dated 5 May 1649, proved in 1650, Executor, wife, Rose.

I, Anthony Paine, in my perfect memory, do manifest my mind and last will is to give and bequeath unto my daughter Alice, one cow, she or husband paying unto my daughter Mary Tripp, so much as the cow is judged to be more worth than the heifer; further my mind and will is to give unto my daughter Mary Tripp one young heifer, and to be made equal out of the cow, and further my mind and will is to make my wife, Rose Paine, my whole and sole executrix, to see my former covenant, and my last will performed and my debts paid, and Mr. Porter and William Baulstone to see my estate equally divided witnes my hand this 5th of may 1649 [Marke of Anthony Paine] William Freeborn [Appears to have signed his name].[12]

Genealogical Dictionary of New England Vol 3 p. 332. Slade-Babcock says: "His first wife was a sister of Robert Potter [Edith Bartlett Bartlett Sumner, Ancestry and Descendants of Amaziah Hall and Betsy Baldwin, Los Angeles, 1954]. He married secondly, in 1643, Rose, widow of Matthew Grinnell, who married thirdly, in 1650, James Weeden. He signed the Compact which re-incorporated Portsmouth on 30 Apr 1639. His will, dated 6 May 1649, was proved in 1650 [c.f. Portsmouth Records, 384]." Children, by first wife, Alice and Mary and a third child who died young.

Thanks Deb, Brent, & Christopher. Since Anderson has done deep research prior to the printing of The Great Migration Directory, published in 2015, I think it's safe to say that is the latest "definition."

Standard procedure in PGM in the case where GMD says origin is unknown is that we add a paragraph called "disputed origins" then detach parents leaving notes and links on their profiles as well.

Any objection to plan going forward? comments?

Only source for parents I've found are in familysearch.org. They are sketchy at best. Uncertain would be a good change until we find more definition.

I would agree. -- I'm assuming that by "FamilySearch", you're referring to a family tree, because when I search the FS vital records database, I come up empty... no Anthony Paine shown born anywhere in Lincolnshire between 1580-1590.

His parents as shown here are currently unsourced. Should they be detached, or at a minimum, marked as Uncertain?
Question accuracy of Rebecca (Paine) Kendall listed as daughter of Anthony Paine. She doesn't appear in the bio. What is the source?

for death, the state is listed as NH which i think is not correct. it should be RI. Posting note instead of changing since I am not 100% sure. Cheers - Rich
Paine-1892 and Paine-244 appear to represent the same person because: Same person. Go with best-sourced info as to dates, etc.
