Benjamin Parker was born about 1798 in North Carolina. He was the son of Peter Parker and Sarah Barnes.

Last Will

I Benjamin Parker of Webster County and State of Kentucky do make and contitute this my last will and testament, hereby revoking all others, Viz:

1st. I desire and direct that an inventory and appraisment of my personal property be made immediately after my decease, and that my Executrix and Execotor proceed to sell either publicly or privately, as they may think best for the interest of my Heirs, A sufficiency of said property to pay any funeral expences, and all my Just debts.

2nd. After the payment of my funeral expences and other debts, I give and bequeath to my wife Mary H Parker during her life-provided she never marry again the tract of land on which I now live, including all my adjoining land, some 350 acres in all, and all my personal property. But in case of her marriage after my death, I wish and direct that she retain one third only of said property during her life, and that on condition that a sufficient legal asurance be given that said property shall be forth coming at her death to be distributed amongst my Heirs, suitable allowance however being made for unavoidable loses, wears and tears in the use of same. Her one third of said land to be laid off to her so as to include the buildings, and her one third of the personal property to be laid off to her, and the other two thirds to go immediately to my heirs. The property left to my wife, is to be used by her in supporting herself, and in supporting and educating our children without any charge to them, and in making such advances to our children as I may hereafter direct.

3rd. At the death of my said wife, she having never married again, I wish and direct that all the property left to her, be equally divided among my children, regard being had to the amounts advanced to those of this several distributive shares. And if any of my children shall then have dies, leaving children, then living, those my grand children, shall be entitled to and receive the portion falling to the deceased parent which portion shall be held by the Executors until said grandchildren marry or become twenty one years old, as which time, as as the case may be, the executors shall pay, said portions to said grandchildren.

4th. I wish and direct that all my children receive equal portions of my estate, except James B Headley my grandson to whom I have given a horse, which I wish, shall be over and above his equal portion of his deceased parent Eliza Headley, and that Mary Headley have the cow and calf, which I have given her, also that she have a bed and bed clothing over and above her equal portion of her deceased parent Eliza Headley.

5th. I do hereby appoint my wife Mary H Parker the guardian of all my minor Heirs.

6th. I do hereby constitute and appoint my wife Mary H Parker Executrix, and my sons William B Parker, Benjamin A. Parker, and John R. Parker, and my son-in-law, John Montgomery, Executors to Execute and carry into effect this my last will and testament.

In Testimony whereof I hereunto set my hand and affix my seal, this 13th day of January 1866.

Signed, sealed and acknowledged in our presence, and sighned by us, as witnesses at the request of the testor, this 13th day of January 1866.

I M C Davis Clerk of the Webster County Court do Certify that the foregoing instrument of writing was this day produced in court and proven by the oaths of Ul. P. Elder and James R Johnson the subscribing Witnessess thereto, to be the last Will and Testament of Benjamin Parker deceased. And the same was ordered to probate & record as such. Whereupon the said instrument of writing together with this Certificate hath been duly recorded in my Office.
