Biography

John Payne

Arrival 1635. In 1642 there is a John Pain arrived by 1642, sponsored by Richard morgan, in Charles, virginia.[1]

He married Margaret Robinson in Rappahannock, Virginia in 1632.[2]

Wife Margaret: There is a U.S. and International Marriage Record of a John Payne from England, birth Year 1615, married to a Margaret Jennings, of Virginia.[4] The biography above notes his wife as being Margaret Robinson, whom he married in Rappahannock, Virginia in 1632.[2]

Three brothers, Sir Robert, John, and William Payne came to Virginia in 1620: Sir Robert returned to England; (John settled in the Northern Neck. (The booklet here quotes Capt. John Smiths History of Virginia). It is also stated in this booklet that John and William were knighted before leaving England. The Payne's were a powerful tribe in Wales. King James I, to conciliate them, gave them a grant of twelve miles square (144 square miles , 92160a., one-third the area of Fairfax county) near Alexandria, called Payne Manor, where Sir John settled. ◦See pages 44-51 of "The Paynes' of Virginia" for more information on John Payne, Sr. He appeared to be a ship owner, as he was paid for provisioning and transporting Burgesses from Lancaster to James Town. He may also have been a carpenter, as in 1656 the county court ordered him to make for the county one pair of stocks and a whipping post.

His date of birth is approximate and is based on an affidavit concerning delivery of pork to Jamestown which states his age as "44 years or thereabouts". This was probably a visual estimate of a Clerk of the Court rather than based on his own oral evidence.

As suggested by the comparatively late date of the Court records relating to his two younger sons, it is not improbable that he was married twice, and that Margaret was his second wife.

John Payne had the following children--Richard, John, William and George. It is believed that he had also one or more daughters; but since his will cannot be found, although it is recorded that he made one, it is practically impossible to identify any such daughters.

Please detach unsourced child Ralph Payne (1620-1670). Thank you, Deb
It seems most unlikely that this upper class man Sir John Payne who came to Virginia was the son of the not-upper class Moses Paine who came to Massachusetts, to whom he is now attached. Moses Paine did have a son John in Frittenden in 1615, but emigrated with three other children in 1638, causing genealogists to assume, reasonably, that he died young. More likely, as suggested in the bio, that this man was either the son of Sir Robert Payne and Elizabeth Rotherham of Huntingdonshire, or, as suggested by Malcolm Hoare, that he was born to a John in Tonbridge ( a castle town 20+ miles away from Frittenden). But not Moses and Mary Paine who settled in Massachusetts

The biography for Moses Paine refers to a son John who died young. There being no evidence for Sir John being the son of Moses, the parents should be disconnected immediately, as their presence simply thwarts appropriate research!

John Payne was baptised 12 Feb 1615 in Tonbridge, Kent (entry states son of John), he married Martha Buckhurst 13 Nov 1638 in Frittenden, Kent. He died and was buried 5 Jan 1681 in Frittenden, Kent. His supposed father Moses who married Marie Benison were married in Tenterden, Kent on 2 Nov 1615, after John was born.

According to my Y-DNA matches I am a 67 marker match to this John Payne. My oldest known ancestor is Wiley J Carter B 1837 in Lincoln Co. TN, D 1910 in Guntersville, AL so there must have been, perhaps, an adoption somewhere along my Carter lines I.E. a Payne that adopted one of my Carters? Thank you!
