Biography

John was born in 1725. In the mid 1700s he assisted Flayle, Jr., in running the Potomac River ferry from "Pain's Delight" in Maryland to Stump's Landing in Loudoun County, Virginia.
By 1782 he had moved southwest to Bedford County, Virginia, where he appears in the tax lists as early as 1782.

He wrote his will on 9 June 1798 in Bedford County, Viginia.
Will of John Payne, 1798
I John Payne of Bedford County do hereby make and ordain this my last Will and Testament in manner and form following that is to say 1th. give and bequeath to my beloved wife MARY PAYNE all the use of profit of my whole Estate both real and Personal during her Natural life or widowhood and at her death or shall she marry then give my Estate away in manner and form as follows that is to say............................ 2ndly. I give and bequeath to may Son WILLIAM PAYNE one hundred and fifty acres of land adjoining the land of JOHN KENNETT,JAMES KERSEY, and WILLIAM McCoy--where he now lives him and his heirs forever. Tis also my desire that my said Son shall make a new line between him and JOHN KENNETT by running a line from Prices Corner straight to where the old line -------- the ? between my son WILLIAM AND JOHN KENNETT. I also give to my said Son WILLIAM PAYNE a set of black smith tools which has now in his possession and also at the death of my MARY PAYNE I give to may said son WILLIAM one Negro Man named JAMES to him and his heirs. 3rdly I give and bequeath to my Son THOMAS PAYNE all the land below a line that shall be run by beginning where mine and JOHN AYERS line crosses the road that runs from? AYRES to my house and running a straight line to the upper end of my son THOMAS fence and then a straight line as the fence runs to my line on the top of the mountain to and his heirs forever. At the death of my wife MARY or should she marry I then give to my son THOMAS my small still to him and his heirs forever. 4thly. I give to my three daughters to CATHERINE KENNETT,MARGERY HAPER, AND SARAH BROWER one Hundred and fifty acres of Land lying on the head of Ayers Mill Creek to be equally dived between them to here and their Heirs forever. 5thly I give to my three Sons to  ? , JOHN, WILLIAM and THOMAS at the death of my beloved wife MARY all the rest of my land to be Equally dived between them to them and their heirs forever. All the rest of my Estate which is not given away in the above I give to be equally dived at the death of my wife MARY between all my children to will CATHERINE KENNETT, JOHN PAYNE, WILLIAM PAYNE, THOMAS PAYNE, MARGERY PAYNE HARPER, AND SARAH BROWN ..? 7thly. I hereby constitute and appoint my beloved wife, WILLIAM PAYNE AND THOMAS PAYNE my whole and sole Executors to this my last Will and Testament given under my hand this 9th day of June 1798

On November 20, 1773, John Payne and his wife, Mary, sold their 34.5-acre share of "Payne's Delight" that his father, Flayle Payne of Maryland (1696-1764) had established along the banks of Potomac River in Frederick County, Maryland near the town of present-day Knoxville. The couple then removed with their family to Bedford County, Virginia, where they purchased 112 acres of land in what is now the Huddleston district of the county. The farmland was situated on the head branches of the middle and north forks of Rock Castle Creek. In 1781 during the War of Revolution, John Payne provided Christopher Irvine, D.C., 200 pounds of beef and four bushels of corn to be used the troops of the Continental Line.
