John is the son of John Payne and Jemina Hutchinson. John was born on April 13, 1751 at Coventry, Tolland County, Connecticut. [1]
John Payne married Lydia Tisdale on May 17, 1775 at the First Congregational Church in Lebanon Connecticut. [2]
At a Court of Probate held at Lebanon in & for the District of Windham Sept. 28, 1787. Present Wm Williams Esq., Judge Mr. John Payne of Hartford in the County of Windsor and State of Vermont (so called) came personally before this Court, and in his own and the behalf of Lydia his wife who is sister to Mr. Nathan Tisdale late of said Lebanon dec. moved to appeal from the sentence and judgment of said Court on the day of last in allowing and approving the last Will and Testament of the said Nathan, dec., to the Honorable Superior Court of this State to be holden at Windham in said State on the third Tuesday of March next; and this Court do admit and allow said motion and appeal on Bond being given according to law. And thereupon the said John Payne together with Mr. Thomas Trapp of Norwich in the County of New London and State of Connecticut, acknowledge themselves jointly and severally bound in a Recogni...ance in One hundred pounds lawful money of said State to Zeviah Tisdale and John Porter Executrix & Executor of said last Will, that said John Payne shall prosecute his said appeal to effect, and answer all damage in case he fails to make his plea good...
In 1778, John Payne Jr., "late a Lieut. in Col. Warner's Regiment, 3 years nearly, and in 1776 was sick" petitioned for a pension from the State of Vermont. The result was "no action taken". [3]
In 1778, John Payne resided in Bethel, Windsor, Vermont. [4]
John moves to Cape Breton in about 1788 and settled in Cow Bay, Cape Breton. Cape Breton Island land petitions recording John Payne's can be found at https://novascotia.ca/archives/land/results.asp?Search=John+PAyNE&SearchList1=3. In 1802, John Payne was residing on a lot at Cow Bay. By 1811, he no longer was living on that property, as he had moved to the Magdelen Islands.
The 1820 Federal Census for Chattham, Barnstable, Massachusetts, lists John Payne, employed in commerce, aged "45 and upwards". He is living close to George Payne, age 25-45, who had a male under 10 years old in the household. George was also employed in commerce. [5]

On 12 September 1821, John Payne, age 69, described his Revolutionary War Service: He was appointed and Commissioned on the 21 October 1776 as Second Lieutenant in the Company Commanded by Abner Sely in the Vermont Regiment commanded by Col. Seth Warner and served principally in New York until June 1778 when he resigned his Commission. [8]
John Payne dies at age 74 on 11 Mar 1825 in Staten Island, New York City, New York. Esther Payne, on behalf of John Payne, "Sergeant & Lieutenant", received a pension in New York, New York. [9]
~~researching 2nd wife: Esther Payne submitted documents in a Widow's Pension stating she was the wife of Lt. John Payne. Included was a one-page certificate of marriage noting John Payne was the son of John Payne, and stating that John married (2) MRS. HESTER VAN CLEAF, widow of the late AARON VANDERBILT, on 06 December 1821 in New York, New York. Today, Dec 11, 2017, I've sourced an 1820 census showing what COULD be her family, but the dates and ages don't add up at this point. John was probably Captain John Payne. He left the USA and moved to Cape Breton in 1788 and settled in Cow Bay, Cape Breton . He moved frequently, possibly the result of his occupation. He was in the Madeline Islands in 1802, Ingonish in 1811 and he witnessed the second marriage of his daughter Sophia to William Commons in the Catholic Church in the Madeilenes in 1814. He probably died there.
Correspondence would seem to indicate that he was a boat builder, a mast builder or had a skill related to the marine industry. He was apparently unhappy with his relocation to Cape Breton, likely a "reluctant loyalist". One can speculate that he had a trade valuable to the British and was forced to relocate to Cow Bay to aid war efforts.
