Campbell or any other person having possession of or liable for the same, a distributive share, which is coming or may be coming to the said Permelia B. Sypert formerly Permelia B. Perry daughter of Benj. and Polly Perry, and her husband Wm Carrole Sypert, from one James High late of the County of Smith and State of Tennessee, all necessary receipts bonds and acquittances for us and in our names to execute for and about the same or any part thereof, giving and granting unto our said Attorney full power and authority to do and perform all and every act and thing whatsoever requisite and necessary to be done in and about the premises as fully to all intents and purposes as we might or could do if personally present with full power of substitution and revocation, hereby ratifying and confirming all that our said Attorney or his substitute shall lawfully do or cause to be done, by virtue thereof, hereby revoking all former powers of Attorney for this purpose In witness whereof we have hereunto set our hands & seals, this ninth day of April 1870 Eighteen hundred and Seventy. This Indenture made this Thirty first day of December in the year of our Lord One Thousand Seven hundred and Ninety by and between William Williams of the County of Franklin and State of North Carolina of the one part Benjamin Perry of the county and State aforesaid of the other part. Witnesseth that the said William Williams for ??? in consideration of the Sum of Thirty Pounds to him in hand paid by the said Benjamin Perry the Receipt whereof he doth hereby acknowledge and himself therewith contented and paid hath given granted, bargained, sold  ????? Released and confirmed unto the said Benjamin Perry his Heirs and Assigns forever one certain Tract or parcel of Land Containing by Estimation, three Hundred and fifty Acres ??????? lying and being in the County of Nash and State aforesaid. Beginning at Reuben William's Corner on ????? Creek at a Red Oak running on this line ???? Eighty Poles to a pine, thence South Two hundred and Eighty poles to a hickory, thence West two hundred poles to a pine thence North two hundred and Eighty Poles and from thence to the first Station the same being granted to Charles Rollings by grant Bearing date the Thirte?? day of November in the year of our Lord One thousand seven hundred and Eighty four. Reference thereunto being had?? will more fully appear and ?????? by the said William Williams to the said Benjamin Perry. Together with all and Singular the Rights and Tenements ???????? and Appurtenances unto the same belonging or in any-wise appertaining to the only proper use benefit and ??????? of him the said Benjamin Perry his heirs and Assigns forever in fee Simple and the said William Williams for himself his Heirs, Executors, Administrators, and Assigns ???? forever Warrant and Defend unto the said Benjamin Perry his Heirs, Executors, Administrators and Assigns the Land and premises together with the appurtenances hereby given granted and bargained and sold free and clear of all manner of incumbrances [sic] whatsoever. The significant parts of this document from a genealogical viewpoint, are the names of Benjamin and James Perry, the date of the document, the counties of Nash and Franklin in North Carolina. This James, who was a witness to the document signing, could possibly have been the older brother of Benjamin Perry, but not for certain. Assuming this James is indeed the brother of Benjamin Perry, he would have been 44 years of age. Benjamin would have been 26 years of age, at this event. Benjamin was born in 1764, and James was born in 1746.
