POLICE COURT.
THURSDAY, May 31st.
(Before the P.M.)
Maria Petersen proceeded against Robert McLachlan for maintenance. Mr Jarvis, of Messrs Maryland and Jarvis, appeared for the complainant, and Mr Murphy, of Messrs Wynn Williams and Murphy, for the defence. As a large portion of the evidence would have been a repetition of that in a previous case the solicitors agreed that that evidence should stand in this case. Robert McLachlan said that he was a trainer and jockey, and was arrested at Clermont on 4th. May. He ceased his occupation about April 27. He had been working for Joe Connolly for 25/ per week, without tucker. Witness was now married. He had been two years and four months in Clermont, and on March 11 rode the mare Iris in a race, coming second, for which he received money. Up to March 20 he was in regular work as a trainer and jockey. If not arrested he would have remained at Clermont if he could have got work. He was still capable of earning his living as a jockey, but was not in strong health, having a delicate chest from severe 'wasting.' At present he was out of work, and his father was supporting him. He could only do light work. His average yearly income would be about £80. and he had to support himself, wife, and child, which he could not do without getting into debt. When arrested he owed about £30. He was not supporting his wife now, and she was staying with her sister. He had paid £26 to complainant having borrowed the money. A doctor had examined him last Friday, and told him he should not do any hard work. James English stated that he saw the defendant about a fortnight ago having a conversation with a man named Harris. Mrs Harris asked witness and an other man to go and get Harris, who was boozing in Milichester. They went down, and the defendant was with Harris, telling him he was pulled for the support of a youngster. He said if he got in for the support of the youngster he would go to gaol, and would not pay anything. The defendant was ordered to enter into a bond to pay £10 in twelve months, £2 10/ to be paid on 1 September 1st. and instalments of £2 10/ at intervals of three months.[1]
