Biography

ABNER PITTS Will dated 27 Dec 1798, Will filed Box 34, Pkg. 70, Estate #811,proved 14 May 1801 Newberry Co., S.C., settlement on 5 Aug 1819 by Chas. Griffin. Legatees: Joshua Pitts, Abner Pitts, grandson (son of Henry), Henry Pitts, Richard Henderson Pitts, Caleb Pitts, Sally [Mary?] Pitts, wife of Seaborn Jones. Will of James Waldrop names Mary Pitts. [Compiler's Note: Mrs. Rourke, informant on the Pitts lineages says she is uncertain of the parents of Abner Pitts. From the connections it is probable that he was a cousin of Henry Pitts whom. Hannah Collier, or possibly a nephew.]

Signed 27 Dec 1798, prov 4 May 1801, recorded 5 Oct. 1802 (he prob died 4 Apr 1801)Legatee: "my beloved wife, Mary..." No others named. [Note: N.B. Mary Waldrop, dau of James and Mary Waldrop, mar Abner Pitts of above will - MDS]."

Actual Text - South Carolina. Newberry County. In the name of God Amen I Abner Pitts of the State and County Aforesaid planter being in a weak sick and low condition of Body but of perfect Sound Mind and Memory Calling to mind that it is appointed Once for all men to die do make and Ordain this to be my last will and Testament In the manner and Form following. That is to say I recommend my Soul to God who gave it and my body to Its kindred Clay to be intered in a decent and Christian like manner at the Discretion of my Executors here after mentioned and as for my Worldly Estate which it hath pleased God to bless me with It is my will and desire to dispose of in the Following Manner; First my will is that all my Just debts and Funeral Expenses to be paid and fully satisfied; My will also is that two hogs head of tobacco be carried to Market and sold for cash and also that my bay mare and her Cold and my Rifle Gun and one Sow and pigs and Six Reap hooks be sold by my Exer's. And the Money arising from the tobacco and property above mentioned be kept in the hands of my Executors to purchase a slave as quick as Convenient. Item My will is that I lend to my Beloved wife Mary Pitts all my lands and plantation and my gray mare and her cold and all my plantation tools of all kind with my gears and swingle trees and all my house hold furniture of all sorts and every thing and parcel else of my property except the property above ordered to be sold with the use and labour of the slave above excepted to be purchased during her life or Widowed and at her death or Marriage my will is that all the property above lent to my beloved wife shall be sold at publick vendue and the money thence arising to be equally divided among all my children as shall be then living and my wife she standing as a child and receiving (the remainder of the page is cut off on this copy.-CW) Page 2 - Testaments or Legacies Ratifying and Confirming this and no other To be my last will and Testament Witness my hand and Seal this 27th day of December anno dom 1795. Pitts-3862 and Pitts-2561 appear to represent the same person because: Same name, exact same spouse on both profiles, based on birth year of one child the birth year on Pitts-3862 seems more appropriate.
