Testimony of John Price in Cumberland County Virginia Court, 1792: ... your Orator John Price of the said county is one of the sons of a certain John Price formerly of the County of Essex but now deceased that the said John [Price] the decedent departed this life sometime in the year 1771 or 2 after having duly made and published in writing his last Will and testament bearing date the 27th day of November 1771 and recorded in the said County Court of Essex on the 16th day of March 1772...after my wife's death or marriage the slaves to be equally divided between all sons...That the sd Thomas Price departed this life leaving John Price his eldest son Heir at law...that Richard Price departed this life also...after writing his last Will & Testament bearing date 23rd day of March 1781...that the said William Price departed this life intestate and without issue...that the said Ann Price to whom the Negroes aforesaid were loaned hath departed this life, and your orator the only surviving brother...anxious to discharge...deceased father's estate..the defendant John (Price) who is son & heir at law of the said Thomas Price lives in the state of North Carolina...the children of the said Richard (Price) are infants and not entitled to his share...[4]
Indenture Abstract 22 August 1781 Cumberland County Virginia Between John Price of Caswell County North Carolina and John Price of Cumberland County of Virginia Consideration of twelve thousand pounds paid to John Price of Caswell County the said John Price of Caswell County does bargain, sell and confirm unto the said John Price of Cumberland a certain parcel or tract of land in Cumberland county containing seventy five acres more or less adjoining Thomas Anderson and Elizabeth Armstrong devised Thomas Price [father of John Price of Caswell] by his father [John Price of Essex] by will bearing date 27th Nov 1771 admitted to record of Essex County court reference being had there as will more fully appear and is part of the tract of land whereon the said John Price of Cumberland County now lives (and is yet undivided)...the said John Price of Caswell does for himself and his heirs covenant and agree to and with the said Price of Cumberland to defend the right title interest and property of the aforesaid land against his heirs and all other persons whatever having or lawfully claiming the same...Ordered to be Recorded 27 August 1781 [5]

The separate answer of John Price Eldest son and heir at law of Thomas Price deceased to a bill in chancery Exhibited against him & others by John Price in the County Court of Cumberland in the Commonwealth of Virginia. This respondent saith that he hath only been informed of ye facts as stated in the complainant bill, and for ought he knows they are true, particularly as they appear to be vouched by the attested copies of the Wills of his grandfather (John Price) and Uncle (Richard Price), to be fair as they relate to the slaves held by his grandmother the sd Ann in the bill mentioned, And as to the friendly services of the complainant, this respondent knows nothing of more than he has likewise been informed, and thinks well deserving of a reasonable compensation, which this respondent submits to the consideration of this worshipfull court, And those gentlemen Under them to be appointed to divide the said slaves. This respondent submits himself to a fair and just decree in the premises as stated in the bill, And begs leave to deny any secret communications or fraud practiced with the other defendants by him or any confederacy with any person or persons as charged in the said bill, And hopes to be ________ ___________ with his share of the said slaves and reasonable costs.
