In the name of God Amen This Twenty Seventh day of November in the year of our lord 1771, I John Price of the County of Essex being in perfect mind and memory do make this my last will and testament in the manner following--- Item, I lend to my daughter Catherine Boulware one negro girl named Lucy during her life and after her death the negro so lent with all her increase to be equally divided between my daughters children. Item, I lend to my wife one negro girl named Sarah during her natural life or widowhood and the increase of the said negro while in my wife's possession to go with the rest of my estate and after my wife's decease I give the girl Sarah to my daughter Susannah with all her increase after possession whether by descent or delivery but if she die without issue of her body lawfully begotten the said with all her increase to be equally divided between my sons here after named. Item, I lend to my beloved wife Ann Price all my negroes namely, Bristol, Bett, James, Ben, Harry, Ned during her natural life or widowhood and after my wife's decease or marriage the said negroes to be equally divided between all my sons, Namely, Thomas Price, Richard Price, William Price, and John Price, but if any of my sons die without issue of the body lawfully begotten their part to be equally divided between the rest. Item, I give to my son-in-law Stark Boulware one-half of my tract of land in Cumberland County to be equally divided the other half of the said tract I lend to my wife during life or widowhood and after her decease to be equally divided between my sons above named. Item, my land in Essex whereon I live to be sold at the discretion of my Exors. I give to each of my three children William, John, and Susannah, one feather bed and furniture and a cow and calf and the rest of my estate [after payment of my debts] I lend to my wife during her widowhood and after her death or marriage to be equally divided among all my children and lastly I constitute and appoint my wife and John Lee Executors of this my last will and testament. Will of John Price. Written 27 Nov 1771. Probate 16 March 1772. [2]

Cumberland County Chancery Court Case confirms identities of the children and heirs of John Price and Ann Younger. ...your Orator John Price, one of the sons of a certain John Price formerly of the County of Essex but now deceased [who] departed this life sometime in the year 1771 or 2 duly made and published in writing his last will and testament...recorded in the said court of Essex on the 16th day of March 1772. The testator, your Orator's father John Price [named in will] beloved wife Ann Price all My Negroes namely Bristol, Bett, James, Benn, Harry & Ned...sons Thomas Price, Richard Price, William Price and John Price...That sd Thomas Price departed this life...intestate leaving John Price his eldest son Heir at Law. Richard Price departed this life...after writing his last Will and Testament bearing date 23 March 1781. William Price departed this life intestate and without issue. The said Ann Price to whom the Negroes aforesaid were loaned hath departed this life. Your Orator [John Price] being the only surviving brother...advised that defendant John Price, son and heir at law of the said Thomas Price, who died intestate...lives in the State of North Carolina. The children of the said Richard Price are infants. Orator request division of said slaves and compensation for his trouble. Other defendants include Mary Price Wright, widow of Richard Price, and Joseph Michaux, executor of Richard Price, deceased.[3]

Ann Price advertised 300A for sale in Essex, Close to church, and Rappahannock, and Grist mill, and Landing. Sold 300A to Thomas Bowler for 186 lbs, 13 Jul 1772. [4]

Will of father John Price deceased about 1726: In the name of God Amen. September 24, 1726 I, John Price, Parish of Christ Church in the County of Middlesex, being low and weak in body but of perfect mind and memory thanks be given unto God calling to mind the mortality of my body and knowing that it is appointed for all men once to die, I make and ordain this my last Will and Testament that is to say Principally and first of all, I give and recommend my soul into the hands of God that gave it and for my body I commend it to the earth to be buried in Christian like and decent manner at the direction of my Executor hereafter named and as touching each worldly estate which it hath pleased God to bless me in this life, I give and dispose of the same in the following manner and form.

I give and bequeath and bequest unto my son Thomas Price my plantation and all my land in the county together with ______ appurtenances _________ to him and his heirs forever. Item I give unto my two sons Robert and James Price all my tract of Land in Essex and King and Queen County to be equally divided between them and their heirs forever and my desire is that they receive their estate at twenty one years of age. Item I give unto my other three sons John, Samuel and William Price, each of them, sixty pounds sterling to buy each of them a tract of land for them and their heirs forever. Item I give unto my daughter Jane Price sixty pounds Sterling after her marriage to ?Capt.?  ?isemand with her other part of my estate. As for the rest of my estate vizt. My Negroes and moveable estate whatsoever, setting apart what is before given, I give to be equally divided amongst my six sons and one daughter. And if any of my children should dye before they come to age then their parts of my moveable Estate to be divided among the survivors. My will is that my son Thomas Price shall have the care and ____tion of my other children so long as he shall do well by them, when it proves otherways that then they or either of them and their estate to be taken out of his hands. Also my will is that my son Thomas Price be of age at my death to act or do anything concerning my estate and my will is that when the first of my children is Qualified to Demand their part of my estate that then it shall be appraised and what it comes to a share to be p. each of y? I do hereby constitute, make and ordain my son Thomas Price my only and sole executor of this my last Will and Testament but in case he should Dye before this my will be performed, then I appoint my son Robert Price my only and sole executor of this my last Will and Testament. I appoint my two friends Mr. Humphrey Jones and Mr. ?Ohmer/Oliver? __________ my trustees to advise my Executor for the managing of my estate. I give to each of my trustees twenty shillings to buy them _______ In witness _____ I have hereunto set my hand and seal the day and year above written. John Price Seal Signed, Sealed, Published and Declared by the ss John Price as his last will. September the 30th of 1726. In testament in the presence of us Thos Greenwood, William Montaque, Catherine her mark Perrott

Whereas in this my last Will on the other side it is mentioned that if any of my children should dye before they come to age then their part of my moveable Estate to be equally Divided amongst the survivors, I do hereby declare it be ______________ that my Negroes in such a case shall go to the survivors in the same manner. John Price At a court held for Middlesex County the 6th day of December this Will of John Price Gent ____ with the Codicil was produced in Court by Thomas Price, Executor therein named who made oath ______ and this Will and Codicil were further proved in Court by the oaths of the witnesses for them. Price-1242 and Price-6583 appear to represent the same person because: Birth year and birth location are the same. Death dates differ.
