The slave, Nancy, was given many years ago by Samuel HORNBACK, dec. to the mother of your respondents, who was the wife of John REED, dec., daughter of Samuel HORNBACK, as part of marriage portion. On 29-Jan-1813, said Samuel, entered a common law complaint, an action of detinue, to recover Nancy and her daughter, Sarah (other slaves named in suit born since then, Charles is dead). The Nov-1813 Term of the Court decided slaves were the property of Jno. REID, Samuel had no title to them. They also claimed the statute of limitations. Also states that Samuel had but 5 children: John, Adam, Daniel, Margaret (m. Adam ALKIRE) and Elizabeth (m. John REID) HORNBACK. Samuel gave 100 acres of land, conveyed by deed to John HORNBACK. Also gave Adam HORNBACK 78 acres by deed, heirs of Daniel HORNBACK, dec. 78 acres by deed, Wm. ALKIRE, the husband, Samuel gave 50 acres. Afterwards, by some arrangement, Samuel purchased back same 50 acres. Samuel never gave any land to his daughter, Elizabeth, their mother, in his lifetime. However, Samuel, during his lifetime, made about an equal distribution to his other children. CONT CONT Samuel made his last will and testament on 8-Oct-1812, devised to his daughter, Elizabeth REID, the respondent's mother, a full share of his estate at this death. Samuel departed this life a few years later. Will recorded & administered in May-1816 term. CONT CONT Some years ago in the lifetime of their ancestor Samuel HORNBACK, he and a certain John REED, Jr. undertook to build and erect a sawmill & water gristmill on Strodes Creek in Bourbon Co., KY. Operated some long time until whole milling establishment caught fire and the gristmill was consumed and burnt to ashes. John REID was indebted to said Samuel for money advanced by him for use and benefit of the said REID of at least ,000. Some time after they commenced building the mill, Samuel became insane, infirm and wholly incapable of transacting any business and was given to frequent intoxication. After mill was burnt, REID, finding Samuel of unsound mind (even in his best health the said Samuel was a meek minded man), REED gave out in speeches that HORNBACK was indebted to him in the sum of 50 pounds. John REED, Sr. and Jr. got Samuel drunk, drew up a note payable by Samuel to John REED and proceeded to execute it in the foiling fake & scandalous manner. That John REED, Jr. took the old man's hand (who was 85 years of age and lying dead drunk) into his hand and thus with his own exertion, fraudulently procured the old gentleman's name on the note. REID received judgement on the debt and kept it secret from HORNBACK's heirs. CONT CONT REID's answer: Mills built by John & Samuel in partnership and continued until fire. Deny Samuel owed John nothing (as stated by complainants) and that John owed Samuel ,000. They state that Samuel had some kind of fit by which his mind for some time appeared to be impaired, but he was not insane or incapable of transacting business. He was toward the close of his life and a little intemperate in the use of ardent spirits. The debt was arbitrated by two millwrights chosen by John and Samuel and they judged in John's favor.
