Biography

John was the eldest son of John Roberts of Spotsylvania and was born in Stafford County, Virginia, prior to 1703 as he had reached his majority when his father died in 1724. He lived to be 100 years old or very nearly as the special agent of the U.S., investigating British merchantile claims. It is stated that John Roberts was one of the oldest men in Culpeper Co. (Virginia Genealogist, Vol. 7, No. 1, page 17). He died in Culpeper County, Virginia.

He married twice:

  • Elizabeth Russell before 1730
  • Mrs. Margaret Humphreys in 1768 (Marriage Contract)

In later land transactions, he listed his residence as Bromfield Parish, Culpeper County, which formed from Orange County in 1748. The bulk of modern Culpeper was in St. Mark's Parish, Bromfield included the northwestern portion of modern Culpeper and virtually all of modern Madison and Rappahannock counties. He obtained 400 acres in 1726 on the lower side of Flat Run in modern Culpeper. He sold that land to the Rev. John Thompson, minister of St. Mark's Parish, Sept. 1, 1749. Culpeper County, Virginia Deed Book A, p. 55-57.[1]

John and his wife Elizabeth were residents in Orange County, formed from Spotsylvania in 1734, when he was named as executor in the will of Malcolm McKenzie of Orange County, dated 1 May 1742. McKenzie bequeathed all of his land and plantation, amounting to 900 acres, to John and William Roberts, sons of John Roberts and wife Elizabeth. McKenzie additionally bequeathed the residue of his estate for the sole use of his executor John, who was granted administration of the estate of Malcolm McKenzie 24 September 1741 with William Russell and Frances Kirtley as security on the bond. Orange Co. VA. Will Book 1, p. 172-173.[2]

The sons of John Roberts by his wife Elizabeth can be determined by following the 900 acres of land bequeathed by Malcolm McKenzie in 1741. He had sons named John, William, Francis, and Benjamin. His son John Roberts died intestate and without issue prior to 10 May 1752 per the following three records, an indenture between John and his son William, a Deed of Gift from John to his son Benjamin dated March 1766/7 naming Francis and William, and a later indenture between his son William and James Robison, Merchant of Falmouth.

This Indenture made the Tenth day of May in the year of Our Lord One Thousand Seven Hundred & Fifty two Between William Roberts of Culpeper County in the Colony of Virginia, Gent, of the one Part and John Roberts Father of the said William of the same County in the Colony afores'd Gent of the other Part Witnesseth that the said William Roberts for and in Consideration of Two young negro Men named Charles and Tom, and the sum of Ten Pounds Current money of Virginia to him in Hand paid by his said Father John Roberts and Delivery of these Presents the Receipt whereof the said William Roberts doth hereby Acknowledge... 400 acres being the uppermost part of a greater tract formerly granted to Malcolm McKenzie by patent 20 May 1735 for 900 acres and a part of an including survey thereof made for 1500-odd acres, all which lands was bequeathed by McKenzie in his last will and testament to William and his brother John Roberts Junr., lately deceased, which by John Roberts' death descends to William Roberts ... in the little Fork of Rappahannock River and on Battle Run and the branches thereof ... on the north side of little Battle Run, corner of land Roberts formerly sold to Richard Young ... crossing great Battle Run ... by a branch ... cross Great Battle Run again ... Young's line amongst a heap of rocks and west side of Battle Mountain ...Wit: H. Field, Pendleton, & Benjamin Roberts. Culpeper County, Virginia Deed Book A, p. 413-415.[3]
To All People to Whom these Presents Shall Come I John Roberts of Brumfield Parish, Culpeper County, planter,... to my loving son Benjamin Roberts of same. For natural love, good will and affection. 200 acres on Great Battle Run, being part of a greater tract of 400 acres formerly granted to me by my son William Roberts by deeds 10 May 1752 ... corner to Malcum McKenzie patent (now William Roberts) ... dividing line between my son Benjamin and his brother Francis Roberts ... in the patent line ... My son Benjamin Roberts shall not be possessed with any part of the above mentioned tract which lies on the north side of Great Battle Run included within any fence during my natural life, anything in the above deed to the contrary mentioned not withstanding. This Indenture made the 17th day of August 1774 Between William Roberts and Jane his Wife of County of Culpeper of one part and James Robison of the Town of Falmouth Merchant Factor and agent for Messrs. William Cunninghame and Companey Merchants of Glasgow Whereas Nine hundred acres of land lying on Battaile Run and Cannon River in said County of Culpeper formerly Orange were granted to one Malcolm McKensie by Patent from the Honourable William Gooch late his Majesties Lieutenant Governor of the Colony of Virginia and dated the 20th of May 1735 and Whereas said Malcolm McKensie did bequeath the said land by his last Will and Testament to John Roberts Junr. and said William Roberts in the year 17[41] and Whereas afterwards in the year 1748 the said John and William Roberts did procure a warrant from the Proprietor of the Northern Neck Office in consequence of which a survey was made so to Include the said Patent and also Six hundred and fifty five acres of surplus land within and waste land adjoining said Patent by William Green Gent containing in the whole One thousand five hundred and fifty five acres of land and Whereas the said John Roberts Junr. has since died Intestate and without issue and by which means his share of the said land has descended to the said William Roberts his Eldest Brother and heir at law Now this Indenture Witnesseth that said William Roberts for sum of Four hundred and Eighty nine pounds Nineteen Shillings current money of Virginia paid by said James Robison hath sold for the use of the said Company the said One thousand five hundred and fifty five acres of land except Three hundred and ninety six acres of the same sold by said William Roberts to John Roberts, One hundred acres sold to Michael Lawler and Two hundred and five acres sold to John Marsh To Hold the said land upon this condition that if the said William Roberts shall truly pay the said Company their Facter or Agent the said sum of Four hundred and eighty nine pounds and Nineteen shillings with legal Interest on or before the 19th day of September next ensuing this present writing shall become void the said William Roberts and Jane his Wife do also hereby sell and Mortgage to said James Robison for the use aforesaid Two hundred and sixty eight acres of land adjoining the former and purchased by said William Roberts of one Compton for the consideration and on condition above mentioned.
