At the Adelaide Local Court on Wednesday, before his Honor Mr. J.G. Russell, S.M., John Barnett Solly, of Eleventh-street, Bowden, laborer, claimed £9 from Joseph Austin, of Gibson Street, greengrocer, as the sole executor of the will of the late Mary Ann Solly, late of Hindmarsh, widow, for balance of money for board, maintenance, lodging, and other necessaries and goods provided for the deceased at her request from Mann 26, 1912, to August 24, 1913, at the rate of 2/6 a -week. Mr C. J. Symon appeared for the plaintiff, and Mr. W. J. Denny for the defendant, who repudiated the claim. His Honor said the plaintiff had done the filial thing in having his mother in his house when other relatives were disinclined to do so, and it would have been only fair of those who benefited under the will had offered to make up any small claim the plaintiff was justly entitled, to. There would be judgment for plaintiff for the
amount claimed. Cecilia Margaret Solly, wife of George Dyson Solly. of East-street, Brompton, and Joseph Austin, of Gibson-street, Bowden, greengrocer, sole executor of the will of the late Mary Ann Solly, for £9 12/ money due for work done, attendances, and services rendered as nurse at the deceased's request, from June 21, 1913. to August 21, 1913. Mr. C. J. Symon appeared for the plaintiff and Mr. W. J. Denny tor the defendant, who pleaded not indebted. His Honor said 'there was a strange want of appreciation, as shown by the defence, of the fitness of things. The parties interested in the little estate ought to have jumped at the opportunity of making amends to the persons who did the hard and charitable work of nursing the old lady in her last days. Judgment would be given for the amount claimed. ' Image attached.
