Biography

Martha Scaggs was born in March of 1849 in Virginia.[1][2]

She married James Burk/Burke[3][4] about 1867[2] and the couple had the following known children:

  1. Elizabeth Burke was born about 1868 in Virginia.[2]
  2. William H. Burke was born in Virginia[2] 09[5]June of 1877[1] and died in Hazard, Perry County, Kentucky on 30 Nov 1943.[4] He is buried in Jellico Cemetery, Jellico, Tennessee.[5]
  3. James Sheffield[6] Burke was born in Campbell County, Tennessee 05[6] February 1880.[2] He died 18 Jul 1932 and is buried in Jellico Cemetery, Jellico, Campbell County, Tennessee.[5]
  4. Menervia "Mellie" Burke was born in Tennessee 15 Apr 1882 and died 17 Dec 1955 in Lafollette, Campbell County, Tennessee.[3][7]
  5. Summer Field Burke was born in Tennessee in February of 1886.[1] She married Wesley H. Leach.[8]
  6. Letitia Burke was born in Tennessee 08 Apr 1889/90[1] and died in Ypsilanti, Washtenaw County, Michigan on 21 Sep 1937.[9]
  7. Richard Wheeler "Rich" Burke was born in Speedwell, Claiborne County, Tennessee 20 Jan 1893.[10][8] He died 16 Aug 1966 and is buried in Academy Cemetery, Claiborne County, Tennessee.[11]

Martha charged James with adultery with Callie Monday, and was awarded a divorce from him on 16 Jun 1899 in Campbell County, Tennessee.[1]

Martha Burk vs James Burk:
16 Jun 1899. In this case on motion of complainant's solicitor it appearing to the court that the defendant, James Burk, is in court by due process, duly executed and served more than five days before the first day of this term of court; that he has wholly failed to appear and make defense to complainant's bill within the time required by law. On motion of complainant's solicitor it is ordered that complainant's bill be and is taken as confessed and the cause set for hearing exparte. And then this cause further came on for hearing upon the bill of complainant, the judgment proconfesso, and the proof heard. From all which the court is of the opinion that complainant is entitled to the relief sought on the ground of adultery with Callie Monday, the same is so adjudged. And further that the bonds of matrimony subsisting between complainant and defendant be and the same are dissolved absolutely and for nothing held and the complainant restored to all the rights and privileges of a single and unmarried woman, and that the care, custoday and control of their children be committed to her. The defendant will pay the costs of this case for which execurtion will issue.[12][13]
