Biography

Joseph Scott Sr. was born about 1708 in St Peters, New Kent, Virginia, son of Capt. John Scott II (1672 - 1729) and Judith (Dudley) Scott (~1679 - 1734).
His siblings were:

  3. Judith (Scott) Jordan (~1704 - 1785)
  4. Edward Scott (1706 - 1738)
  5. Samuel Mosely Scott (1708 - 1755)
  6. Martha Frances (Scott) Flippen (1716 - 1794)
  7. Martha Frances (Scott) Garrett (1716 - >1793)
Joseph married Sarah Mayo , daughter of William Mayo and Frances Gould, on 8 Dec 1734 in Goochland, Virginia.[1][2][3][4] Their children were:
  1. Margaret (Scott) Fry (1729 - 1787)
  2. Frances Ann (Scott) Walker (1733 - 1816)
  3. John Scott (~1735 - 1772)
  4. Capt. Joseph Scott Jr. (1735 - >1780)
  5. Sarah (Scott) Clement (~1740 - <1821).
Joseph died before 20 Jan 1749 in Amelia aged ~40.
There was a chancery case concerning his estate in Amelia County, Virginia in 1758. Joseph’s wife Sarah, executrix of his estate, had since remarried to Robert Jones. Joseph’s son John Scott, now over 21 and guardian of his sister Judith, complained that Sarah has not executed the Will properly.[5]

In The Name of God Amen I Joseph Scott of Amelia County, being sick and weak but of sound memory. Do make this my Last Will and Testament as Followeth.
Item. My Will is that my Loving wife Sarah have the Life? And Profits of the mill and Plantation whereon I now live During Natural life. And also the life? And benefits of Six Slaves (losue Tamer, Rosoman, Cupitt, Cuffee, Chester, Quaco ?urconey? his Live. Also the wife of all my Stocks? of Cattles Hoggs, Sheep, Horses and Household furniture and utensils belonging to the Plantation Until such time as my Son of Sons com[e] to age or my Daughter or Daughters Marrie and then my Stocks and Household furniture which shall then be in being to be Equally divided between my Said Wife and all my Children which shall be then living And at the Death of my Wife all the negros lent her to be divided among all my children Equally.
Item. I give to my Daughter Judith One Negro Girl named Doll
Item I give to my Son John one negro man named Harry I also give to my said son John two hundred pounds our money I likewise give to my aforsaid son the Plantation whereon I now live with the mill after the Death of Sarah my wife. To him my Said Son and his heirs forever……
Item. I give to my son William all my Land in Goochland County to him and his Heirs forever also I give my Said Son one, Negro man named Dick… My will is that my wife have an?? life and profit of my Plantation in Goochland and all my slaves not before mentioned until my Son John com to Lawfull age. To enable her to bring up and Educate my Children And at the time my Said Son John shall obtain to such age Then all those negros not before mentioned to be equally divided between all my Children.
Lastly I constitute and appoint my loving wife Sarah executrix, my Friend George Carrington and my two Sons, John and William Executors of this my Last Will and Testament and desire they may not be compelled to give Security for the due execution of this my Will nor to have my Estate approved

At a Court held for Amelia County this 20 day of January 1748 The last will and Testament of Joseph Scott was presented in Court by George Carrington one of the executors therein named who made oath hereto and proved by the Oath of Thomas Barton One of the Witnesses to the Said Will. And at One other court held for Said County the 20th? day of July 1749 Sarah Scott the Executrix mentioned in the Said Will made each thereto and it was then alsoe proved by the Oaths of Samuel Scott and FipPe? Scott hoo other witnesses hereto and ordered to be Recorded.

Research Notes

It has not been established that the Barbados Mayo family is the same Colonel William Mayo who surveyed the dividing line between Virginia and North Carolina, although he was also in Barbados. That Wm may have settled in Isle of Wight County after leaving Barbados and married to Isobel Hardy.

I note that the only daughter named in the Will is Judith. So far I have seen no actual evidence for the names of the the two oldest daughters listed in the Biography. I have been looking and have not found info that supports the names of Margaret Fry or Frances Ann Scott as his daughters. Also, their birthdates given here indicate they would have been born before the date of marriage. Other researchers have gleaned the following info from St. Peter's Parish Register:

SAMUEL son of Capt. Jno. Scott Baptised Feb. 6, 1708/9. SARAH Daughter of Capt. John Scott Baptised 8ber 1710. MARY Daughter of Jno, scott Gent: Born February 17th 1711/12. JANE Daughter of Jno Scott Gent: by Judith his Wife Baptd. ffeb:7th 1713. MARTHA Daughter of Jno: Scott Gent: Born 28th April 1716. JESSE Son of Jno. Scott Born May 1718 It's likely that the older children, John, William, Edward, Judith and Joseph were born before they started recording births or they were in a different location. Thus I believe that Margaret Fry and Frances Ann should be removed as daughters of Joseph Scott and Sarah Mayo.

Lineage Caution:

Capt. Joseph Scott Jr. may not be the child of Joseph Scott Sr. and Sarah (Mayo) Scott (1714 - 1775). This lineage is a guess and needs verification.
