Taunton North Purchase
To all Christian people to whom these presents shall come Malachi Holloway of Taunton within the County of Bristol in their Majesties Province of the Masachuset Bay and Elizabeth his wife send Greeting &c Know yee that the said Malachi Holloway and Elizabeth his wife for and in Consideration of Six pounds and ten Shillings Lawfull Silver money of New England which by these presents they Do acknowledge that they have received, before the Ensealing of these presents of John Philips of weymouth in the County of Suffolk in the Province aforesaid, to their full Content and Sattisfaction, and thereof by these presents fully absolutely and Clearly Exonerate acquitt and Discharge the said John Philips & his heires Executors and Administrs for Ever Have Given Granted Bargained Sold Made over Confirmed & Delivered, and by these presents Do give grant Bargain Sell Make over Confirme and Deliver unto the said John Phillip and to his heires and assignes for Ever Halfe a share of land in the North Purchase so Called by Taunton men which North Purchase is a Tract of land lyeing on the Northerly Bounds of sd Taunton and was Purchased of the Agents of Plimouth Colony by some of these Taunton as may appeare by a Deed Signed by Thome Prince Josiah Winslow Thomas Southworth & Content Southworth the aforesd Agents, which Deed bearing Date June the Sixth one Thousand Six hundred Sixty & Eight, which Halfe Share above mentioned is the Hundredth & Sixth part of the whole Tract & Mentioned in said Deed above Mentioned there being fifty three whole shares in said Tract to have and to hold the above said halfe share of land in the above said Upon the said Halfe Share or any manner of way thereunto belonging according to the above to Origninal Deed with all the Estate Right Title Interest & Demand of them the said Malachi Holoway & Elizabeth his wife or Either of them unto the Premises or any part thereof for Ever unto the said John Philips and to his heires and Assignes for Ever, Morever the said Malachi Holoway and Elizabeth his wife, Do by these presents for themeselves their heirs Executors and Administrators Covenant & promise to & with the said John Phillips and his heires & assignes that they the said Malachi Holoway and Elizabeth his wife are the true and proper Owners of the above said Halfe share of land and Promises and that they have in themselves Good Right full Power and Lawfull authority intheir owne Names to give grant Bargain Sell makeover Confirme & Deliver the same as above sd and taht it shall be lawfull to & for the said John Phillips his heires and Assignes for Ever hereafter to have and to hold to Improve & Quiety possess the same and by them the said Malachi Holoway & Elizabeth his wife and their heires Executrs and Administrators Well and Suffeciently Saved and Kept Harmless and Indemnisyes, of said from all former and other [illegible] Gifts Sales Morgages Leases Dowers Joyntures Recognisances Judgemtns Executions Charges Troubles Suits at law or any Enrumbrances that may arise by any person or persons layeing any Just Claime thereunto for Ever In wittness whereof the said Malachi Holoway & Elizabeth his wife have hereunto sett their hands and seals this first Day of August in the year of our Lord Sixteen Hundred Ninety and four and in the Sixth Year of the Reign of King William & Queen Mary over England &c Memorandum the word [assignes] in the Twenty fifith line and Enterline before the Signeing hereof
