Biography

John Spencer was born about 1673 in Northumberland County, Virginia. He was a minor when his father Nicholas died in 1689. On April 28, 1703, Willoughby Allerton (abt.1664-bef.1724) relinquished his Guardianship of John Spencer, Gent., son of Nicholas Spencer, Gent. and Madame Francis Spencer, both deceased but formerly of Westmoreland County, Colony of Virginia.[1] Shortly thereafter, Willoughby Allerton, as the Executor of Nicholas Spencer brought an Chancery action against John Spencer.[2]

Wardship

Francis Spencer an Orphan son of Nicholas Spencer Esqr and

Mad:m Frances Spencer both late of this County decd

having formerly made choice of Willoughby Allerton Gentl

to bee his guardian for that John Spencer Gentl one of

the sons & Executors of the sd Nicholas Spencer Esqr decd keeps &

detaines in his possession all or greatest part of

the estate of the sd Nicholas decd and refuseth to deliver to

the sd Willo: Allerton such part of the sd estate as hee ought

to bee posest with in right of his sd ward, hee the said

Willoughby Allerton doth now in open Court

wholly disavow the said Wardshipp and relinquish all pretense

of right to or with his sd Ward or his estate which hee

prays may be entered on the Records of this County, Which

is accordingly admitted[1]

In court records his wife "Mary" was named as Executrix of his will. Also, a son Nicholas and daughter Francis are mentioned.[3]

Since Nicholas Spencer line is of the Diana / Winston clan that All claim to descend from the Norman-French (who came down as Danish Vikings to France), their DNA Haplogroup would be E1b1b (aka: E-M35, etc.) and NOT the R-M269 Haplogroup that these Spencers of Gent. John Spencer's descendants have all tested-out as. So this is a line that's been "cobbled-together" from 2 or more non-related-by-blood Spencer groups.

John Spencer, son of Nicholas died in 1720, not 1725 and did not have any surving male children, I suspect this is a different John Spencer.

Spencer-352 and Spencer-6986 appear to represent the same person because: These appear to be the same person. Same parents; very close birthdates.
