Scottish Record Office, HM General Register House Edinburgh 7-4-1830 Robert Stewart & Archibald Anderson concerns theft of 4 mutton hams from a slaughterhouse in Carlton owned by Peter McInnes. Stewart was apprehended along with William Stein also a carter on 8-1-1830.Declaration by Stewart states he was 22 years old , a carter residing in Calton, Glasgow.

Trial Robert Stewart. Warrant dated 1830-02-13 Robert Stewart a carter residing in Calton ,Glasgow,born stirling,was arrested & kept prisoner at Tollbooth,prison,Glasgow.Robert had been under suspicion of being a thief for the past two years

West Register House Edinburgh Robert Stewart : Warrent 13-2-1830 arrested & kept prisoner at Tollbooth prison Glasgow. Trial Saturday evening 30-1-1830, 7 pm. Robert Stewart had been to a public house and had said he could get butter.There was another man involved named Anderson and a woman named Lindsay. There was a shop at the north side of Gallowgate and the shop had a cellar in the close (entrance) which the shopkeeper used as a store to keep his butter, flour and cereal.The key to the store was kept hanging in the shop, they had taken the key and stole the butter valued at sixpence per pound. They were cahased and Anderson threw his butter away in Gibson Street. There were 13 witnesses , some being people he had offered butter to before stealing it. Guilty - 7 years Transportation Ship “ Burrell “

Robert arrived with 192 other Convicts and was assigned to Road gang. Some time later he was assigned as a shepherd to Mr John Jones who had a sheep property between Denman and Coolah. In October 1833 Robert was committed to stand trial for stealing a sheep valued at 10 shillings. Robert was found guilty and sentenced to re-transportation,this sentence was acquitted and Robert was given an extra 3 years added to his original sentence.

2-6-1840. Robert received his certificate of Freedom, described as Small scar left side of forehead, lost front tooth on left side of jaw, Arrived 1830 “Burrell “ Tried for sheep stealing 1833.

1840. Robert Stewart Age 33, Bachelor, Arrived “Burrell “ 7 years now free by servitude applied to marry Mary Neil, Age 26, Spinster, 7 years, Arrived Sir Charles Forbes, Convict On Bond in service to Thomas Crawford at Wollombi. Permission granted, 31-8-1840 R/Catholic Church, West Maitland.

Mary gave birth to the following children

William 27-12 -1840, Their residence was Sussex St,Sydney

Ellen. 30-3- 1843, Their residence was Kent St, Sydney

Robert. 7-7- 1845, Their residence was Kent St, Sydney

James. 19-11-1849, Their residence was Clarence St,Sydney

David. 19-4-1853, Their residence was Newtown.

In 1851 - 1852 Robert was paying rent on a brick house with shingle roof on Kent St,Sydney owned by Michael Murphy.

Possibly this Robert Stewart - 10-1-1854; Maintenance, Robert Stewart represented as a habitual drunkard was charged with deserting his wife & family on 1st December last and has since neglected to support them,Five weeks ago he deserted his wife & 5 children.An order made for payment of 25 shillings per week for 12 months.

Robert date of death is unknown, His Wife Mary states he is dead on daughter Ellen’s marriage Certificate 1859. but later states that he deserted her about 1855 ?

Maitland Quarter Sessions 1833. Robert Stewart two others sheep stealing at Turee property of John Jones between Denman & Coolah, 3 years added on to Robert Stewart original sentence.

Certificate of Freedom. Robert Stewart 40/929. 1840-06-02. Ship "Burrell" 1830. Small horizontal scar top left side forehead. Lost front tooth left side of upper jaw. Remarks. Was sentenced to transportation for life by quarter sessions for sheep stealing,which sentence was acquitted by Col.Sec Dated 1836.10-19.


Permission to marry. Robert Stewart Age 33. Arrived per "Burrell" 7 years,now free.Bachelor Mary Neile. Age 26.Arrived "Sir Charles Forbes" 7 years,spinster.on bond. 1840-08-31 Maitland.Roman Catholic.


Robert Stewart born 1807 Stirling Scotland was trialled and convicted at Glasgow on April 7, 1830 for stealing butter. He was sentenced to 7 years penal fortitude and was transported to Plymouth NSW Australia aboard the ship Burrell 1. He arrived on 19 December 1830 and was assigned to roads special order. Convict Indent Number, 730 Rff-032-627 Received his Certificate of Freedom June 2, 1840 - CF No. 40/0929 Robert was born about 1807. Robert Stewart ... He passed away after 1853. Sydney NSW.
