Biography

John Stone, the Immigrant, received a land grant in 1725 in what was to become Caroline County, Virginia. John died in 1737, and his wife Mary was the executor of the estate. His estate was probated on 13 January 1737/8 in Caroline County, Virginia.[1]

John Stone may have been the same John Stone that was included as one of 10 headrights on a Land Patent claimed by James Taylor in 1695. It was not unusual for people to wait years before claiming, and there are other records that suggest there was some association between James Taylor and John Stone. In 1704, King and Queen County, John Stone, with James Taylor, Thomas Pettit, John Baylor, and Robert Powell received a Land Patent for 4500 acres for importing 90 people into the Colony. Also in 1704, John Stone and Mary (O’Brissell) his wife of King and Queen County, deeded to Valentine Mayo, 107 acres in Middlesex County on September 2, 1704. This was land mentioned in the will of Thomas O’Brissell (also mentioned in the deed). Also in 1704, the Quit Rent Rolls for King and Queen County list John Stone with 295 acres and Mary Stone 100 acres. (Mary’s 100 acres is probably the 100 acres left by Thomas O’Brissell to his grandson, John Stone, who is not yet of age and sold in September). In 1725, John Stone of King and Queen County receives a Land Patent in King William County for 175 acres. This MAY be John Stone "Jr" as he would have been about 35 years old. King William County is on the opposite side of the Mattaponi River from King and Queen, and the land in this patent fell into the part of King William that became the St. Margaret's Parish portion of Caroline County in 1727. In January 1737/38, Mary presented herself as Executrix of his estate in in Caroline County, Virginia: January 13, 1737/38 (Actually 1738) The Last Will and Testament of John Stone, dec’d, was presented in Court by Mary Stone, Executrix therein named who made oath thereto according to law and being proved by the oaths of James Pendleton and Elizabeth Pendleton two of the witnesses thereto it is admitted to record and on motion of the said Executrix and her performing what is usual in such cases. Certificate is granted her for obtaining a Probate thereof in duo form she giving sufficient security to wit Eusebius Stone and Thomas White. (Was Thomas White a son-in-law?). This John Stone (wife Mary O'Brissell) has a more complete profile and should probably be merged with Stone-1277. Does anyone have any issues with that?

The father of Steven is likely John Stone "Jr," b. abt 1680, died 1735 (Stone-26796). See my comments on your page.

Why is John Stone, b. abt 1690, not shown as a descendant? He is named by Thomas O'Brissell in his will. Supposedly, he died about 1735.

His son John Stone is mentioned in the biography, but there isn't a profile for him because, at least so far, no one has created a profile for him.

John Stone's Last Will and Testament was presented in court on Jan. 13, 1737/38. This is actually 1738 due to the calendar year running from April 1 through March 31. So his death was likely at the end of 1737, not 1736. The court order can be found at https://www.familysearch.org/ark:/61903/3:1:3QSQ-G9PH-TDGV?i=392&cat=403144 (you may need to sign on first). Scrolling through the images, the January court proceeding followed December, 1737 and preceded April, 1738.
