Will of Elijah Stuart, Wells, York, Mass., 2 May 1812[1]

In the name of God, amen. I Elijah Stuart of Wells in the county of York & commonwealth of Massachusetts, being weak in body, but of sound and perfect mind and memory, blessed be almighty God ofr the same, do make and publish this my last will & testament, in manner & form following, (that is to say),
First, that my funeral charges and debts, if any there are, shall be at my decease, be honorably discharged.
Secondly, I give and bequeath unto my beloved wife Eunice Stuart, during her widowhood, or the time she shall remain my widow, all the ral & personal estate whatsoever I may be possessed of at my decease, excepting such bequests as I shall hereafter make in this my last will and testament.
I do also give and bequeath unto my oldest daughter Tabitha Gray, the sum of five dollars.
I do also give and bequeath unto my grand child, the heir of my daughter Polly Hatch deceased, the sum of five dollars.
I do also give and bequeath unto my daughter Ruth Treadwell, the sum of five dollars.
I do also give and bequeath unto my youngest daughter Issabella Stuart, the sum of twenty five dollars. Which said several legacies or suns of money I will order shall be paid to the said legatees, by the executor of this my last will and testament, within twelve months after my decease; excepting the legacy given to my dauhter Issabella, being a minor, I direct to be paid at the age of eighteen years.
I do also give & bequeath unto my son John Stuart, my only survivng son and male issue, all my wearing apparel, and all my farming utensils and other tools. I further give and devise unto my said son John Stuart, all my real estate, which I bequeath unto him to take possession of at the decease of my beloved wife Eunice Stuart, or at the time she shall (if she should) change ger condition of marriage,
Lastly, I do hereby appoint my beloved wife Eunice Stuart, with my son John Stuart, executrix and executor of this my lasy will & testament, Hereby revoking all former wills by me made.
In witness wherof, I have hereunto set my hand & seal, the second day of May in the year of our Lord, one thousand & eight hundred and twelve.

Signed, sealed, published & declared by the above named Elijah Stuart to be his last will and testament, in the presence of us, who at his request, and in his presence, have hereunto subscribed our names as witnesses to the same.

He was called Elijah "third" to distinguish him from Zebulon's3 son, who was called Elijah, jr. (pp. 80, 91). He died in 1812. His will, ated May 2, 1812, names wife Eunice, eldest daughter Tabitha Gray; his grandchild, heir of his daughter Polly Hatch, deceased; his daughter Ruth Tredwell; his youngest daughter Isabella, a minor. and his son John "only surviving male issue."
