Wybregh Jansen, the widow of Jan Siercx dec'd of Appoquinimink, this day appearing in Court did produce a certain matrimonial contract made by way of a Will between her the said Wybregh and her said deceased husband Jan Siercksen bearing date the 19th of October 1676. Desiring that the Court would allow thereof and admit the said Wybregh to administer upon her said husband's estate accordingly. [2]

The Court having seen and examined the premises did think fit to admit her the said Wybregh as administratix to administer upon the estate of her deceased husband Jan SIERCKSEN , according to law and the contents of the said matrimonial contract. Which the Court does order to be recorded, and that she the said Wybregh JANSEN give security according to law. [2]

Justice Garrett OTTO declared in Court and put himself security for ye performance and due administration of Wybregh JANSEN of the premises.[2]

Followeth the above said matrimonial contract:[2]

On the 19th day of October 1677 appeared before me Ephraim HERMAN, clark of the town and jurisdiction of New Castle in Delaware, admitted by the Right Honourable Mayor Edmund ANDROSS, Governor General under his Royal Highness James , Duke of York and Albany, etc. of all his Territories in America, and before the witnesses here after mentioned, Jan SIERCX, bachelor born at Holstein and at present at Appoquinimink of ye one and Wybregh JANSEN born at Ditmarsen, widow of Barent HENDRICKS of the other party, also dwelling at Appoquinimink afforesaid, who unamimously declared in the fear of God to have agreed to join themselves in the state of matrimony and to ye end that hereafter all differences and mistakes may be taken away. They the said comparants thought good to make and stipulate the following matrimon ial contract:[2]

  1. First that the children of her the said Wybregh gotten by her first husband Barent HENDRICKS dec'd named Annetje, Agnietje, Poulus and Styntjen BARENTS, be by the said comparant Jan SIERCKSEN taken and held as his own children and are to be by him brought up until the said children become of age (or with consent) to the estate of marriage and married, and after the decease of both the comparants and not before, they the said children shall then (alone or with ye children that by God's blessing shall begotten during the time of this now beginning matrimony) inherit and enjoy each proportionable, their full shares of all the estate, so as the same shall be left by the longest lived at his or her decease and in case it might happen that she the said Wybregh might first depart this world, and that then he the said Jan SIERCX might resolve to marry again; then he the said Jan SIERCKS is and shall be obliged before the solemnization of the said marriage, to give and deliver unto the above mentioned children together with those and such children as shall this wedlock be procreated, the full and just half of all his estate and goods moveable and immoveable, none excepted so as the same then shall be found in being. [2]
  2. But in case he the said Jan SIERCKSEN shall first die and depart this world, in such case he the said Jan SIERCKSEN, doth hereby make and ordain as his only and universal heirs the children above mentioned together and with the children which yet out of this ensuing wedlock shall be procreated, which said children shall have and proportionably divide the whole estate and goods provided and it is to be understood that she the said Wybregh JANSEN shall remain in possession of the whole estate during her lifetime or so long or until she shall happen to marry again, then she is obliged to pay and deliver unto the said children the one half of all the estate and goods. In the same manner as herein before of Jan SIERCKSEN is expressed.
  3. In confirmation of ye truth hereof the comparants together with ye underwritten witnesses have hereto set their hands and seals desiring that hereof might be made and past an instrument in Comma Forma, A ctum New Castle in Delaware.[2]
