Mary Katharine Kyle probably descends from the Kyles who settled in Buckingham County, Virginia, though this has not been satisfactorily proven to date. Her father, Robert Kyle, was born in County Tyrone, Ireland, as was her mother, Betty Ann Campbell. Robert Kyle migrated to America with his brothers, Patrick and James. Robert and Betty migrated to Virginia and settled in Albemarle County in 1756 (in the area that became Buckingham County).
Mary Kyle married three men who served in the American Revolution. She was made a widow twice when John Fletcher was killed at the Battle of Brandywine and the subsequent death of Arthur Johnston, who had considerable property in Washington County, Tennessee (NC). She had one son, John Fletcher, Jr. by her first husband and may have had daughters by her second husband, Arthur Johnston, though further proof is needed. She married lastly or consorted with John Michael Smithpeter according to the pension application filed by John Michael Smithpeter. However she retained her name as Mary Johnston (Johnson) and continued to own property in her own name as is evidenced by deeds filed in Carter County, Tennessee. Before Mary Kyle, also known as Mary Johnson/Johnston died, John Michael Smithpeter married Christena Strevelstrut Miller in 1815 according to the marriage records of Carter County. It is unknown at this writing whether John Michael Smithpeter and Mary Katharine Kyle were divorced or if they were in fact ever legally married. Mary Johnstone/Johnson began selling off her property in Carter County after John Michael Smithpeter married Christena Miller.
William and Joseph Kyle, who are probably Mary's brothers, removed from County Tyrone to Virginia after Robert and Betty Ann Kyle in July 1759. They lived in Richmond until January 1760 when they removed to their father's plantation until spring. The brothers and their wives then settled in Botetourt County, Virginia. Both William and Joseph Kyle served in the American Revolution from Botetourt County, Virginia (Source: Annals of Southwest Virginia, Lewis Summer, p 1396). William Kyle married Sara Stevens in 1750 in County Tyrone. William died in 1821 in Fincastle, Botetourt County, Virginia.
Joseph Kyle, probably another brother of Mary Katharine Kyle, was born in 1732 in County Tyrone, Ireland and died in 1807 in Virginia. He married Jane Disguid of Scotland. They had ten children: Elizabeth, Rosalie, Ann, Mary, Jane, Martha, Robert, Margaret, William, and Christopher. Mary's alleged brother, Robert Kyle, Jr. was also born in Ireland in 1739 and died in Tennessee in 1818. He married Leah Brooks. He lived first in Virginia and then removed to Hawkins County, Tennessee. He and Leah reared ten children on their farm known as "Walnut Hill" located west of Rogersville. The well-known historian, Prentiss Price, is a descendant of this family. As an elderly man, Robert Kyle served in the War of 1812; he became ill while leading his troops and was discharged. They raised ten children who were respected citizens.
On 4 November 1782 an entry appears in the Washington County, North Carolina (now Tennessee) Court Records, Volume 2, on page 181 as follows: "Michael Smithpeter, Prin'l in the sum of 50 pounds Specie; Elijah Robertson & William Davis Securities in the sum of 25 pounds each on conditions the prin'l appear from day to day During this Court & Not depart ordered.
Mary Johnstone, Prin'l in the sum of 50 pounds Specie; Security in sum of 25 pounds specie on Condition the prin'l appear from day during this Court & not depart without leave ordered."
Then on page 182 as follows: "The State vs M. J. Peter & Mary Johnson -- Indictment Petit Larceny
On being arraigned say they are not guilty. Robert Lusk, William Storey, Thomas Gillesby, Hugh Stephenson, Isaiah Hamilton, John Reding, Joseph Bullard, Joseph Durham, Robert McCombs, Andrew James Hill and Alexander Willson - Jurymen.
On page 184 appears the following entry in this matter:
"Wednesday morning met according to adjournment. Mary Johnson who was found guilty in the Indictment with John Michel Smithpeter confesses that she was with the said Michael S.peters Guilty of the charge & Begs Mercy, vis. The court order the said Mary Johnson to be commited to gaol for the time of 15 minutes." (No mention is made to the punishment of John Michael Smithpeter.)
On 11 Feb 1786, the 10th year of our Independence, at Greene County, Tennesssee, MARY JOHNSTON witnessed a deed of Indenture between HENRY EARNEST, of Greene County, State of Franklin, planter one part, and JACOB HICE, planter, other part, 100 pounds paid, 45 acres in said Greene County on north side of the Nolichuckey river. Deed signed by MARGARET EARNEST. Other witness were JOHN BROWN and JONATHAN LANGDON. The deed was registered 25 January 1799. (Greene Co., TN Deed Book 1:302). This indicates that Mary Johnston in 1786 was not using Smithpeter as her surname.
Records indicate that between circa 1786 and 1792 that Mary gave birth to four children by John Michael Smithpeter -- George, Caterin, Mary, and John Michael Jr.
On the 2nd Monday of August 1789 at Washington County, Tennessee on the sanction of JOHN MICHAEL SMITHPETER and MARY JOHNSTON, the court ordered that GEORGE the son of said MARY and JOHN MICHAEL SMITH PETER, his reputed father, "be from this time known and called by the name of GEORGE SMITH PETER." (Washington Co., TN Court Records, Vol. 1, page 400, 2nd Monday of August 1789)
Also on the 2nd Monday of August 1789 a Deed of Gift was recorded in the Washington County Court Records on page 400 in which JOHN MICHAEL SMITH PETER deeded to his son GEORGE SMITH PETER 347 acres of land. This gift of deed was acknowledged in open court and admitted to record and ordered to be registered. (Washington Co., TN Court Records, Vol 1, page 400, 2nd Monday of August 1789.)
On 9 April 1791 John and Ruth Hoskins sold to CATRON SMITH PETTER two hundred fifty acres on the south side of Roans Creek for a consideration of two hundred pounds adjacent to William Runals and John Virhees. The deed was signed by John (X) Hoskins and Ruth (X) Hoskins and witnessed by William Mourland, Sarah (X) Mourland, and MICHAEL SMITHPETER. (Washington County TN Deeds page 233)
By 1795 MARY JOHNSTON, aka MOLLY JOHNSTON,is mentioned in a deed which indicates that she owned land on Stoney Creek in Carter County near John Michael Smithpeter's property, probably through her late husband, Arthur Johnston. On 27 August 1795 North Carolina Grant #1166 deeded land to Landon Carter, a 50 share of the 100 acres, of 640 acres on Stoney Creek adjacent to said Carter, GODFREY CARRIGER'S Blue Spring survey & MOLLY JOHNSTON'S. Registered 17 October 1799. (Carter Co., TN Deed Book A:218). This would indicate that in 1795 Mary Johnston was not using Smithpeter as her surname and that she and John Michael Smithpeter were very close neighbors.
On 25 April 1799 at Carter County NATHANIEL TAYLOR, Sheriff, deeded to MARY JOHNSON, 50 acres of a 200 acres survey, South of the Watauga River (JACOB MINGER & ABEL PEARSON vs HENRY RIPPY). GODFREY CARRIGER SR., buyer at Vendue, had requested the sale. Witnessed by CHARLES WHITSON, MORDICAE BOON & GODFREY CARRIGER,Jr. Proved Feb. Court 1800. (Carter Co., TN Deed Book A:255,266). (Mary was still not using Smithpeter as her surname.)
In1802 her daughter, Caterin Smithpeter, married James Bradley.
In 1808 Mary's nephew by brother William Kyle, Robert J. Kyle, and his family removed from Botetourt County to Lee County, Virginia. Mary Katherine Kyle's granddaughter, Orpha Bradley with her husband Samuel Ward, later settled in Lee County in about 1830. Robert Kyle and his family lived in Jonesville, Virginia. He rode horseback into Hawkins County, Tennessee while building their home on the farm he had bought, known as "Walnut Hill." He established his home there on the Clinch River in 1810. Kyles Ford was named for him. Her youngest brother, David Kyle, was also born in Ireland. He and his wife, Elizabeth Chambers, lived on his father's plantation in Buckingham County, Virginia. They had seven children: Nancy, Jane, Barklay, Joseph, Roland, Pocahontas, and George Washington. (Note that further proof needs to be established as to this lineage for Mary.)
On 11 August 1802 MARY JOHNSTON deeded to Samuel Musgrave fifty acres of land on the north side of the Watauga River for a sum of $100. Christian Carriger and Henry Carriger, Jurat witnessed the deed which was proved in February Court 1803 in Carter County. (Carter County Deed Book A:418/419) Note that in the 1830 census that Samuel Musgrave is enumerated on page 22 of the census only three properties from David Brooks and his family. John Michael Smithpeter Sr. was enumerated on page 26, while Mary Johnston's son-in-law, James Bradley, was enumerated on page 25. Again this would indicate that Mary Johnston owned property very close to John Michael Smithpeter, Sr. and that she still was not using Smithpeter as her surname. (Samuel Musgroves was an elected constable in Carter County.)
In 1812 Mary Smithpeter, daughter of Mary Kyle and John Michael Smithpeter, married Reuben Brooks in Carter County, Tennessee. Her son, John Michael Smithpeter, Jr. probably married Mary Stonecypher at about the same time as their oldest child was born in 1813. Her daughter, Catherine Smithpeter, and her husband, James Bradley owned property on Roans Creek and by this time were raising a family of their own.
On 14 August 1816 John Bowman and his wife, Elizabeth (D) of Green County, MARY JOHNSTON, Nicholas (S) Grindstaff and his wife Mary (Z), David Brooks and his wife Easter (L) Brooks sold to Hardy Pierce for eighty-four dollars, thirty seven and one half acres and thirty three and three quarter acres on Stoney Creek granted to ARTHUR JOHNSTON. William Tompkins, Jurat, George Morton , and William Garland witnessed the deed 5 January 1817. The deed was proved in February Court in Carter County in 1818. (Carter County Deed Book C:163). Mary Johnston still had not assumed Smithpeter as her surname.
On 16 August 1816 at Carter County, Tennessee MARY JOHNSON (MOLLY)& ELIZABETH BOWMAN of Carter County and SAMUEL MUSGROVE & his wife ELENDER/NELLY MUSGROVE of Greene County, TN, sold 320 acres of 640 acres on Stoney Creek , granted by Tennessee to ARTHUR JOHNSON, to JOHN GRINDSTAFF for $1,000. Witnessed by NICHOLAS GRINDSTAFF Jurat, JOHN PERCE, Jurat. Proved August Court 1816. (Carter County, TN Deed Book C: 134/135). Note that in the 1830 census for Carter County, Tennessee that John Grimestaff is enumerated on the same page as John Michael Smithpeter, Sr. and is listed only twelve names below him on page 26. This would indicate that Mary Johnson and Arthur Johnson owned property very close to John Michael Smithpeter and that they were close neighbors while Arthur Johnson was living. Also in 1815 John Michael Smithpeter had married Christenia Miller Strevelstrut, indicating that he and Mary Johnston may have been estranged by that time.
On 16 August 1816 at Carter County, JOHN BOWMAN & ELIZABETH BOWMAN, his wife, of Greene County, TN, DAVID BROOKS & EASTER BROOKS, his wife, & MARY JOHNSTON, all of Carter County sold to NICOLES GRAINDSTAFF & MARY, his wife, for $160 ___ acres on Stoney Creek, it being part of the tract granted to ARTHUR JOHNSTON. Witnessed by WILLIAM TOMPKINS, HARDY PIERCE, Jurat, 5 January 1817, signed by JOHN BOWMAN. THOMAS PAGE & SAMUEL MUSGROVE. Proved February Court 1819. (Carter County, TN Deed Book C:210,211). Note that in the 1830 census for Carter County that Nicholas Grimestaff is enumerated on page 25 and that James Bradley, Mary Johnston's son-in-law through daughter Caterin Smithpeter, is enumerated also on page 25 and nine names below Nicholas Grimestaff. Note also that John Michael Smithpeter, Sr. is enumerated on page 26, indicating that his property was very nearby to that which Mary Johnston sold in 1816. Note also that Mary's daughter, Mary Smithpeter married Reuben Brooks in 1812.
On 11 February 1819 MARY JOHNSTON's spring is mentioned in a deed between WILLIAM B. CARTER, GEORGE DUFFIELD & his wife SALLY, of Carter County to JAMES P. TAYLOR for $100, 231 acres of Grant 969 to LANDON CARTER, deceased, crossing MARY JOHNSTON'S spring & Stoney Creek. Wtinessed by John Wright, Jurat. & Labon B. Williams. Proved Feb Court 1819. (Carter Co., TN Deed Book C:269). Note that in the 1830 Census for Carter County James P. Taylor's name appears at the twenty-ninth name after John Fletcher, Mary Johnston's son. John Fletcher appears on page 5 of the census and James Taylor on page 6, indicating that Mary's property was probably very nearby to her son, John Fletcher.

Note:
Mary Kyle first married Arthur Johnson who was killed in the Battle of Brandywine in 1777. She remarried John Fletcher, then John Michael Smithpeters.
One source speculates that John Michael Smithpeter and Mary Kyle Fletcher Johnson did not marry; that Mary Kyle Fletcher Johnson/Johnston probably went south to Washington County, NC/TN after the death of John Fletcher, possibly with Arthur Johnson; that John Fletcher and Mary probably lived in Pennsylvania because everyone who fought at the Battle of Brandywine came from PA (unless of course John Fletcher did not die in that battle). Records exists for changing her son George Johnson's name to George Smithpeter with the specification that his parents are Mary Johnson and John Michael Smithpeter. There are some deeds in which Michael Smithpeter conveys land to her children, George and Catrin, when they would have been children. This may be due to the parents being unmarried.
