Last Will and Testament

From: "Caldwell Co KY Will Book B" by Jerome: B:122 Will of William GRAY, 4 Dec 1841 In health and disposing mind. Debts to be paid from debts due me. To beloved wife Lydia GRAY, my negro man Thomas (or Tom), Synthia his wife and their son Charles and $3,000 in money and such of the house hold and kitchen furniture as she may choose to keep for her own use. This devise, to wit, to my wife is only for natural life and is hereby vested in the hands of my executors whom I constitute her trustee and they are directed to appropriate the interest of the money legacies to her maintainance and use to let remain in the possession of the other property given to her. Also devise to her the house and lots on which we now reside with the appurtenances therewith attached. If she should marry and the property given her is likely to be wasted, my executors are directed to take the same into their possession and apply the profits to her use. After her death the property and money to be equally divided amongst such of my children as are hereinafter named. I have advanced to such of my children as have arrived of age, married or left me (except to my daughters Sarah Louisa Jane STONE and Susan BIRNEY) the sum of $1750 each and it is my desire tht all my children (except Sarah Louisa Jane) have an equal portion of my estate. I direct executors, at the division of my estate, to retain the sum of $1750 for any of my children that have not received the advancement above and then divide the balance equally between them all, except Sarah Louisa Jane, which make them equal. As I have not advanced to my daughter Susan BIRNEY the amount of $1750, I hereby direct that she have advanced to her whenever called for, as it is now in my hands $322, she having received $178. Also bequeath to her one negro woman Sophia, valued at $750 and a negro girl Caroline at $500. It is at her option to take the $322 in money or a negro girl named Maria, daughtaer of Sophia. My slaves that remain at my death to be sold by executors on a credit of 15 months and the proceeds divided as above mentioned, as also all lands, stock & c. To John GRAY in trust and to be for the use of my daughter Sarah Louisa Jane STONE (wife of George STONE), $500, the interest of which together with $25 of the princepal the trustee is to apply to the use and benefit annually and should she die, this bequest is to go to her children alone and shoud she die without issue, this bequest to revert to my other children, to be equally distributed amongst them and this sum is all which she is to have in any way for reasons which in my Judgment are sufficient. To my grandchildren, Pernecia, Elizabeth and William GLENN, children of my daughter Matilda GLENN, $1,000 with interest at 6% from 3 June 1837, to be equally distributed amongst them and their mother having received $750 by way of advancement as they come of age or marry. To my grand daughter, Pernecia Lucinda WALL, daughter of Lucinda WALL dec'd, $100 with interest at 6% per an. her mother having received $750 advancement, to be managed by my executors for her use and beneft and in regard to the blaance of my estate, I will that she receive as her mother would had she lived, an equal distribution. But in case she die without issue, the estate is to revert to my other children and be by them equally distributed. This devise is to be given to my sd. grand daughter when she comes of age or marries. Whereas I have borrowed different sums of money from Thomas KEVIL, Mrs. PARKER, Thomas PARKER and others at the rates of 9 and 10%, it is my express desire that my executors see that such per cent is punctually paid. In regard to my grandchildren, Pernecia, Elizabeth and William GLENN, they are to receive in the distribution of my estate as their mother would had she lived, that is that they occupy her place and have one share as she should have, to be divided equally. In case they or any of them die the estate reverts to those of them living and it is to be paid to them as they marry or come of age. Appoint my son John GRAY and my sons in law Joseph W FOWLER and Thomas G PETTIT executors /s/ William GRAY. Wit: James C WELLER, Chas. B DALLAM. Codicil, 12 Aug 1846. I now will that Pernecy BLUE, Elizabeth GLENN and William GLENN, children of my late daughter Malinda GLENN have to be divided equally between them as before stated, $1000 more thatn is given to them in the will, with interest from 22 July 1842, which will make them equal with the others, that is to make the share they receive through their mother $2750 as given to my other children above named and John R BLUE and Pernecy his wife. I have paid their full portion of sd/ $2750 and the two children are to receive the other 2/3 of the $1000 given in my will with interest from 3 Jun 1837 and the $1000 here given with interest from 22 July 1842. To my grand daughter, Lucinda WALL, another $1000, which will make her equal and the board, tuition and clothing, which I give to her is to be considered and taken as in full of the interest on the $1000. /s/ William GRAY.
