Answer of William & David Lowry:

Administration granted 5/3/1847 to Utter, a stranger from another state. She was the widow of John Wallace who died about 1793, married their father about 1796, lived in Blount Co. until about 1819 then Monroe Co. until their deaths (William about 1820 and Ann in 1843). In 1808 William Lowry, embarrassed with debt, deeded 3 slaves to Abram Wallace son of John & Ann Wallace but retained possession and bound Wallace to re-convey them later. In 1819 or 1820 parents made deed of gift to respondents of negros in return for lifetime support. Deed drawn by Col. John Lowry, decd., witnessed by his wife Jane Lowry, decd., proved before County Court Clerk, decd., burned in Court House fire of 182-. In 1825 Abram Wallace, being then sick and fearing that he would die, assigned title to slaves to respondents on back of 1808 deed (exhibit 1). Slaves: Jane 70, Hannah 45, Harry 23, Levi 21, James 17, Nathan 12, Jane 5. Father William died intestate with no administrator. Ann had no debts, was supported by respondents. Answer delivered to court 9/13/1848.

Complainant Witnesses:

Margaret Lowry, age 42 years, 8/20/1849: Acquainted with Ann Lowry for several years on Island Creek (Monroe Co.) until I moved 10 years ago. Not seen her since. Ann lived with son William. Said she gave negro to daughter Polly Edington, negro died, wanted to give another daughter of Hannah.

Mary Ann Trotter, age 49 years, 8/20/1849: Knew Ann from 14 years ago on Island Creek until her death. Moved to Hiwassee purchase about same time 21-22 years ago, after land sales before office opened for land entry. Ann said she wanted to give Hannah's youngest, Nathan, to John Edington, and next older one to a Wallace.

Ann Baker, 8/20/1849: Knew Ann 4-5 years before death. Lived with William some and David some. Ann wanted to give negro to Polly Edington, who had but one son who was lame from white swelling.

Respondent Witnesses:

Joseph A. Upton, 8/20/1849. Knew David & William slightly in 1825, more in 1827 or 1828, knew Ann in 1828 or 1829. Respondents supported Ann. Had store with David in Morgantown and later in Monroe Co. Negros always claimed by respondents.

William Upton, age 59, 8/20/1849. Knew Ann slightly in Blount & Esq. Lowry, intimate after her move to Island Creek in 1824 or 1825, until death. Known respondents since 1819. Negros lived with respondents and were their property. Respondents supported old lady. Ann said they gave negros to respondents.

John B. Tipton, age 51, 8/20/1849. Knew respondents & mother slightly in 1820, more in 1825. Respondents always claimed ownership of negros. They lived on land they sold to Wm. Snuggs.

John McCrosky, age 60, 8/20/1849. Known family since 1818 until their deaths. Old man died in 1820 on Bat Creek near its mouth in Monroe Co. I then moved 7 miles to Fork Creek. They moved the fall after his death to their current home on Island Creek. I collected taxes as Sheriff from 1820 to 1830, respondents claimed negros as theirs. David worked for me to pay off father's debts of $12 in Knoxville, also $6.30 for my brother.

Will A. Upton, 8/21/1849. Knew Ann & sons about 1831 until now. Respondents always owned negros. James Edington, half-brother, never claimed them. David bought things for his mother at a store.

John Shuts, age 53 1/2, 8/21/1849. Knew William & Ann 35 years ago until their deaths. She died at Wm. Lowry's house. Negros belonged to old man until his death, then respondents. James Edington & wife never claimed them.

Aseneth Edington, age 65, 8/21/1849. Mother Ann said they gave all property to sons for their support by deed of gift. Mother was 83 at death in 1843. Talked with sister Mary about them too.

William S. Callaway, 8/15/1849. Elected Clerk of County Court of Monroe Co. June 1829. Remembers deed of gift from father to William & David Lowry. Never read it before it burned in fire in spring of 1833.

Augustin Lillard, 1/21/1850. Saw deed of gift in possession of parents, they said they had given property to respondents.
