Note: I, Stephen G. Whited, of the village of West Troy, county of Albany and State of New York, being mindful of the uncertainty of life and being desirous of making proper provision for the support of my widow and the care of the property I may leave at my decease, do hereby make, publish and declare this my last will and testament in the manner following:
I. After the payment of my just debts and funeral expenses, I authorise my Executors hereinafter named (in case such a tombstone shall not have already been provided) to procure and erect on my lot in the Rural Cemetery, a double tome stone, the cost of which shall no exceed one hundred dollars and which shall be suitable for both the graves of myself and wife.
II. I authorise and direct my Executors to set apart and deposit in some Savings Bank the sum of One hundred and fifty dollars (in case there shall be remaining so much of my personal estate,) which, together with the earnings or interest thereof, shall be used to defray the funeral expenses of my widow Imogene Whited.
III. I give and bequeath unto my wife Imogene Whited all my household furniture, for the use of herself and minor son.
IV. I hereby give to my Executors hereinafter named the charge, control and management of the real estate of which I die seized, authorising them to rent or lease the same, collect the rents thereof, and out of and from such rents to pay all taxes and assessments upon or against said property insurance premiums to keep the said property properly insured, and likewise such repairs as may be necessary to preserve the property and keep it in good tenantable condition the balance remaining to go to my wife Imogene Whited for her support and I hereby direct that such payments to my said wife Imogene Whited shall be made by my Executors monthly, And in order that my Executors may always be preparedt o meet and pay taxes and insurance premiums as the same shall become due, I request them to lay aside each month from the rents received such an amount (proportionate) as the them shall seem necessary for such purpose.
V. Upon the death of my wife Imogene Whited, I hereby give and devise the said real Estate also [] to my sons and daughters, to wit George B.Whited, Stephen W. Whited, Rollin A. Whited and Clarissa Drake, to hold the same as tenants in common.
VI. All the gifts, bequests or devises in this will contained in favor of my wife, Imogene Whited, are made upon the express condition that they are to be received and accepted by her in lieu of dower.
VIII. I hereby nominate and appoint my son Rollin A. Whited, an Executor, and my daughter Clarissa Drake an Executrix of this my last will and testament[.] And I authroise and empower the said Executor and Executrix in settlement of my Estate and of any debts, and if they think it advantageous to my Estate to accept in satisfaction less than the full amount thereof.
In witness Whereof, I have hereunto set my hand and seal this seventeenth day of September, in the year of our Lord one thousand Eight hundred and Eighty six[.]
