In the matter of the Petition of William Whiteside of said county to adopt Mary Ann Whiteside, minor daughter of John Whiteside, deceased. In open court March 21, 1868 being of the March term A.D. 1868 of County Court of said county came the said William Whiteside in behalf of his petition heretofore filed on the first day of this term for leave to adopt as his own child, Mary Ann Whiteside, a female child whose father is dead.
And it appearing to the court that Ellen V. Whiteside, the mother of said child is still living and has had due and timely notice as appears by affidavit on file herein of the pending of this Petition and further the said Ellen V. Whiteside appearing in person before the court in answer to said notice and being examined and interrogated by the Judge of this court solemnly and of her own free will consented that it should be ordered by the court as prayed in said petition.
And the court being now fully advised in the premise by satisfactory evidence doth find that it will be for the interest of the said Mary Ann Whiteside to be adopted by said William Whiteside.
Whereupon it is adjudged and ordered by the court that the said female child, Mary Ann Whiteside, is hereby declared to be the adopted child of said William Whiteside, the petitioner, herein and capable of inheriting his estate equally with this own children of his body and the name of said child shall remain unchanged and shall be Mary Ann Whiteside.
Further is ordered that the petitioner pay the cost of this proceeding. John M. Wilson, County Judge.
