John Womack Jr. was a Virginia colonist.

John was born about 1676 in Henrico County, Virginia. He is the son of John Womack and Mary Akin. His date of death is unknown at this time. He is last found in records in 1738 in Prince George County, Virginia (see Timeline below).

John married Mary Unknown probably about 1712 in Prince George County, Virginia. In that year he purchased 93 acres of land, later sold in 1718. In 1714, his father granted John 200 acres of land "on the north side of Black Water Swamp, adjoining the swamp and George Reves."

John is listed as the oldest son and sole administrator of his father's estate in the will of John Womack dated Oct. 18, 1725 and recorded February 8, 1725/26.[1][2]

At a court held at Merchantshope for Prince George County, on the Second Tuesday in February, being the Eighth day of the said month; Anno Dom; 1725. -
The above written Last Will and Testament of John Womack deced; was Exhibited into Court by his Son John Womack his Executor, who made oath thereto - and it being proved by order of the oath of Duglas Irby a Wittness thereto, by Order of the Court is truly Recorded; and on the motion of the said John Womack and his giving Security according to Law, Certificate is granted him for Obtaining a Probate of the said Will in due form. test. Wm Hamlin ClCur[3]

Timeline

  • John left Henrico County and settled in Charles City County, Virginia along with his father and other members of his family in 1692. This is the part that became Prince George County in 1704.
  • 9 Dec 1712, George Pasmore and Edward Burges to John Womack Jr, for 14#, 93a in Westopher parish, bounded as in patent for same, granted said Pasmore 29 Apr 1694, assigned from said Pasmore to said Burges and admitted to record 8 Dec 1703. Signed George (JP) Pasmore, Edwd (B [sideways B]) Burges. Wit: Wm Garry, Wm Stainback. Recorded 11 Dec 1712, wife of Burges relinquished dower.[4] Note: this is the same parcel sold to Hannah Headworth in 1718.
  • On 9 August 1714, John (X) Womack Sr. & Mary (X) Womack of Prince George County, transferred to John Womack, Jr. of the same County 200 acres on the north side of Black Water Swamp, adjoining the swamp and George Reves.[1]

  • Court 9 May 1738. John Womack on jury. [Bernard Sykes on same jury, likely related to Richard Sykes, first husband of Julianna LNU who later married William Womack.][6]

Marriage

Records from this time period are scarce. No marriage record has been found for John, who probably married about 1710-1715. No will has been found written by this John Womack, so no record of his acknowledgment of either wife or children.

Only one piece of evidence has been found to indicate the name of John's wife -- a land sale recorded in 1718 in which "Mary wife of John relinquished her dower."

13 Oct 1718, John Womack Jr of PG to Hannah Headsworth of PG, for 13#, 93 acres in Westopher Parish granted to George Pasmore 29 Apr 1694. Wit: James Thweatt, Robt Glidewall (R his mark). Signed John Womack (M his mark [looks more like an upside down W]). Recorded 14 Oct 1718. Mary wife of John relinquished her dower.[7]

It is maintained by some Temple family researchers that Mary was Mary Temple and that they had a son, Temple Womack.[8] However, a little digging shows that the John Womack who reputedly married Mary Temple was believed to have been born about 1700 and to have died about 1785.

Disputed Wife

The "evidence" on which the attribution of Hannah Headworth as wife is based on a will written by a John Womack on 10 February 1787 in Prince George County, Virginia, and proved in court 11 September 1787. In it that John Womack names his "dearly beloved wife Hannah," sons Travis and Nathaniel, and "all my children." (There is no source proving Hannah's surname is Headworth.) Other records indicate this John and Hannah Womack had the following children:

  1. Travis Womack (died 1803, no issue)
  2. Nathaniel Womack (died before 1803, no issue)
  3. Jane Womack (died before 1803)
  4. Mary Womack (died before 1803)
  5. Sarah "Sally" Womack (1779-1822) married Thomas B Bryant[9]

At the time the will was written, John Womack had a wife and several minor children. The will specifically requires that his wife Hannah use the estate to keep "all my children together and support them out the same." The terminology definitely indicates that at least some of the children were under the age of 21. [10]

If the John Womack who died in 1787 was the same as the John Womack who was born about 1676, he would have been over 110 years old at the time the will was written. This is not really believable. The two John Womacks both lived in Prince George County, Virginia, but at different times and they are not the same man. It is possible, of course, that they are father and son, or nephew or grandson. No record has yet been found proving the names of the children of John Womack born 1676.

It is suggested that Hannah Headworth be removed as wife of John and that Mary Unknown be added instead. Shirley Dalton 16:50, 14 June 2020 (UTC)

Hannah Headworth is being removed as wife of John Womack Jr. There is absolutely no evidence that they were married. The only connection located between John Womack and Hannah Headworth is the sale of land from John to Hannah in October 1718. On that date John was married to Mary Unknown.
Womack-723 and Womack-213 appear to represent the same person because: same birth & death dates; same parents
