Will of W P Acree

May 9, 1938


I, W P Acree, being of sound mind and body, do hereby will the North half of my land to my daughter Golda Fawcett, do dispose of as she sees fit.

And the South half o f my land to be entailed on my two sons, Garrett Acree and W. P. Acree, also my stock and personal property I will to my two sons: at their death to be divided between their heirs, (If any) and my six daughters equally-whose names are as follows: Eunice Mixon, Annie Gambreal, Essie Bolton, Italy Moose, Lois Workman and Stella Richardson. I will the above six daughters One dollar each.

I want my daughters, Stella Richardson and Golda Fawcett to be administrators of the estate without-bond.

This land is located in Graves County, Ky. precinct two.

I, C H Bennett, Clerk of the County Court in and for the state and county aforesaid, do certify that the foregoing instrument of writing purporting to be both true land will and testament of W P Acree, deceased, was produced in the Graves County Court on the 5, day of August, 1930, and offered for probate, and G M Davidson and C H Dalrymple, the two witnesses to said instrument living without the bounds of the sate of Kentucky, and residing in Memphis Tennessee a commission was ordered to take their depositions, and on the 25, day of August 1938, their depositions were received through the mail and disclosed the following facts, vie:

"We were present and saw the said W P Acree sign his name to said paper writing and he then declared same to be his true last will and testament and acknowledged same to be his free act and deed; that at the time of signing same he was of sound mind and disposing memory; that at his request, in his presence and in the presence of each other we each signed our names as subscribing witnesses court, on the evidence of said witnesses through their thereto. Then at the same term of said / depositions which were legally taken in the State of Tennessee, it was ordered and adjudged by the court that the said instrument was the true last will and testament of said W P Acree, deceased, probated as such and ordered to record and I have recorded same and this certificate in will book D page 583 in the Graves County Court Clerk's Office.

For the consideration of the sum of Twenty Seven Hundred & Fifty dollars paid and to be paid, as follows, viz: Fourteen Hundred dollars in hand paid, the receipt of which is hereby acknowledged, and Three notes as follows one note of this date for Four Hundred Fifty dollars due Mar. 1st 1919 and payable to J. W Pucket, One note of this date for Four Hundred Fifty Dollars due Mar. 1st 1920 and payable to J. W Pucket and one note of this date for Four Hundred Fifty Dollars, due Mar 1 1921 and payable to J. W Pucket all notes bearing interest of 8% from date. We J. W Pucket and wife S. E. Pucket of Lynville, Ky, Graves Co. have sold and here convey, with convent of general warranty, to W.P. Acree the following described real estate, lying in Graves County, Kentucky, viz: 40 acres of land on Know Creek being a part of the south W corner of the S. W. Or. of Sec 31 T1 R1 East being the Three acres on which the building stands also a part of the S. E corner of said Qr. on the state line being 37 acres making a aggregate total of 40 acres being lands deeded to J. W Pucket by deed of R. T. Bennett & wife on the 22 day of Sep. 1910 recorded in D. B 9 P 469 Graves Co Clerk's office also 25 acres of land off of the S side of the S. E Qr of Sec 35 T1 R1 East beginning on the South line of said Qr on the state line of Ky & Tenn and at said Bennett S. W. corner of the creek, thence west with the south line of said Qr to S. E corner of J. W Simmons thence N with the west line of said QR for enough to contain 25 acres thence E parallel with said Creed to the beginning being said land conveyed to J. W Puckett by R. T Bennett by Deed dated 23 Sept 1910 recorded in C B 14, P 538 Graves County Ky also a parcel of land off of the west end of the S W Qr of Sec 36 T1 R1. East beginning at R. T Bennett N. E corner with J. M Fly, thence E to E. P. Rhodes land thence south with said line to J. H Harris lands thence west to the seo line thence north to the beginning containing 16 acres more of less. Being the same land to which grantors herein derived title by deed from R. T Bennett dated Sept 25 day 1910 of record in Deed Book 48, pate 75 in the Graves County Court Clerk's office. To have and hold the said real estate and the appurtenances thereunto belonging unto the said W. Pa Acree and his heirs and assigns forever, a lien being retained on the property conveyed to secure payment of the unpaid purchase price. In witness where of , we , the said Grantors above named, hereunto set our hands, relinquishing our respective rights to courtesy or dower and homestead exemptions in and to said real estate this 29 day of Sep 1917

State of Tennessee, County of Weakley, I, Font Gibson a Notary Public, in and for the County and State aforesaid, do certify that the foregoing deed was produced to me in my county and acknowledged by J. W. Puckett and wife S. E. Puckett on the 29 day of Dec 1917, parties thereto to be their free act and deed;' all of which is hereby certified to the proper office for record on this 29 day of Dec. 1917. My commission expires on the 1 day of Jan. 1919
