In 1880, the family would remain on the farm in Washington County[3] [4]

Unable to identify the source location of the information saved to Ancestry, but images and summary info indicates that his maternal grandmother, Sarah, was a slave in Virginia, owned by James Robinson. In 1803 James prepared documentations of manumission for Sarah, her twin brother Swany and a younger sister and their subsequent progeny, that would come in effect when the children reached age of 21. In the interim years, James died and his widow who inherited the slaves, did not free them. She subsequently married (and divorced) James Fitzgerald in Tennessee. Sara located the manumission documents about 1854 and sued for freedom for herself and her descendants. Sarah died prior to final judgement, but the end result was in her favor. There appears to be a sum of $800 of compensation owed to the previous owners and documents show that the descendants worked as indentured servants for a period of years to gain their ultimate freedom. This document shows that Joseph Fitzgerald was indentured to James W Deadrick in 1860 for a period of two years, thus his appearance on the 1860 Census.
