A former soldier who came home to Lismore and found his wife in bed with their nine-year-old daughter and another man was

petitioner for a divorce. Judge Storkey found the issue of adultery proved in the affirmative. Sydney Ernest Hermann, of Lismore, sought a divorce from his wife, Mildred Eliza Hermann, with Clarence Roy Johnson, of Ballina, as co-respondent. :Hermann said he was married on September 26, 1934 to Mildred Eliza Elford at Casino Church of England. There had been five children but the first died in infancy.

Hermann said he went into the army in April, 1942. Before going to New Guinea late in 1943 he asked his wife if it were true she was carrying on with other men, but she denied the reports. He intercepted a telegram arranging a meeting at the Post Office and signed by a man's Christian name.
Hermann said he forgave his wife and left for overseas three weeks later. In August, 1945, he received a letter from his wife after he had returned from New Guinea. She asked for a divorce and said she was in love with an other man.
Hermann said he secured compassionate leave and, in the early hours of September 9, found his wife in the bedroom in her night attire. Johnson had jumped off the bed. Johnson made a rush at him with a shoe, but Herman said he swung a right and then got a headlock on Johnson as he ducked.
Hermann said he told his wife to get out as soon as she could get ready. His sister stayed with the children. Hermann's sister, Mrs. Dulcie Gaudron, of Brisbane, also gave evidence.
