John Urquhart was born about 1767 at Strathpeffer, Fodderty, Ross-shire, Scotland. His father, Hector Urquhart, was a farmer. John’s mother was Christy MacKenzie.

John was a tailor. He could not write.

On the 12th of June 1794, he purchased his darling house in the burgh of Dingwall from Doctor Robert Grant sometime physician there bounded as follows: that piece of lot second from the High Street of Dingwall section of the Park consisting of forty feet in length and twenty-six in breadth .

John Urquhart married Anne MacDonald in Dingwall on the 9th of August 1799.[1]

At Tain the twentieth day of March eighteen hundred and fifty-eight years. Which day the following inventory of the personal estate of the deceased John Urquhart Tailor in Dingwall was presented by Alexander Hay, sometime writer, in Dingwall, now in Dundee, and the same is of this date recorded in the company of? Of Ross and Cromarty viz

Inventory of the personal and moveable estate of the deceased John Urquhart Tailor in Dingwall Parish of Dingwall and County of Ross, who died there on or about the ___ day of March last 1856. Faithfully made and given of by John Fraser Senior saddler in Dingwall spouse of Christina Urquhart or Fraser, one of the daughters and nearest of him of the said deceased John Urquhart, and Simon Macdonald Blacksmith in Dingwall spouse of Winifred Urquhart also daughter and one of the next of kin of the said deceased John Urquhart. Disponees and beneficiaries under a settlement of their late father, the said John Fraser Senior and Simon Macdonald having been decerned Executors Dative foresaid by decree of the Commissary Depute of Ross and Cromarty on the ___ day of November 1856 signed John Fraser

(Signed) John Fraser, George Cameron At Dingwall 24 Nov 1856 In presence of George Cameron Esquire Commissary Depute of Ross and Cromarty Shire, compeared the before named and designed John Fraser Senior one of the executors dative of the said deceased John Urquhart, who being solemnly sworn and examined deposes that the said deceased JohnUrquhart died at Dingwall on or about the ___ day of March last 1856, and the deponent and the said Simon Macdonald entered upon the management of the deceased’s personal estate as executors dative as aforesaid in right of their spouses the said Christian Urquhart or Fraser and Winifred Urquhart or MacDonald two of the next of kin of the said defunct. That the said deceased John Urquhart left a Trust Deed and Settlement dated 5 March 1842 which is herewith produced and signed by the deponent and commissary depute as relative hereto. That the deponent knows of no other writing left by the deceased relative to the disposal of his affects or any part thereof. That the foregoing inventory which is signed by the deponent and the commissary depute as relative hereto is a full and complete inventory of the personal estate of the said deceased wherever situated, and belonging or due beneficially to the deceased at the time of his death in so far as the same has come to the deponent’s knowledge and that the value of the said estate situated in Scotland is of the value of fifty pounds and under the value of one hundred pounds sterling. I, John Urquhart Tailor in Dingwall considering that it is the duty of every man in his lifetime to settle his affairs in such a manner as to prevent all disputes after death- and having full confidence in the integrity and abilities of Mr. Alexander Stewart Merchant in Dingwall and Mr. Alexander MacDonald ? deal or there for executing the Trust hereafter reposed in them, Do hereby assign, dispose and convey to the said Alexander Stewart and Alexander MacDonald and to the survivor of them who shall accept and to the person or persons such survivor shall assume with him as ? but that always in Trust for the uses and purposes after specified. All and sundry lands, tenements and heritages of whatever kind and determinations and particularly that my darling house in the burgh of Dingwall purchased by me of Doctor Robert Grant sometime physician there bounded as follows: all and whole that piece of ? lot second from the High Street of Dingwall section of the Park found out by the said Doctor Robert Grant, consisting of forty feet in length and twenty-six in breadth bounded on the South by the piece of ground fenced to Alexander MacDonald Shoemaker in Dingwall on the East by the Tenement belonging to the deceased John Cameron weaver on the Forth by the lot of said park fenced by the said Doctor Robert Grant to John Ross Cartwright and on the west by the Lane running through the middle of the said park conform to ten contrast by the said Doctor Robert Grant to me the said John Urquhart dated the twelfth day of June 1794 - or also my whole moveable a person the means and estate of whatsoever kinds, kinship, moveables included, at present belonging to me or which shall belong to me at the time of my death or that of my wife Mrs. Anne MacDonald or Urquhart ho should she survive me is hereby expressly understood and appointed by me to inherit my said whole heritable and moveable means, after which and at the decease of the longest lives of the two, my said trustees are hereby informed to sell and dispose of the said house stables and moveable property either by public sale or by private bargain as they find most advantageous for the trust - and I bind and oblige me and any heirs and successors to Grant all necessary deeds in favour of my said trustees for implementing as follows filling the above General Disposition of my ? and moveable means and estate. And I do hereby nominate and appoint my said trustees to be my executors and with my moveable means and estate, but dealing always that these present me granted for the ends and purposes after mentioned viz. That the said trustees in the first place pay any just and lawful debts that I and my wife, if she survive me, may be owing at my and her death, as well as funeral expenses. In the second place that the said trustees pay any necessary and reasonable expense of accounting and finally including this trust and thirdly that my said trustees make an equal division if the residue of my heritable and moveable estate and means to my five daughters viz, Mary Urquhart widow of Alexander Clarke, Christy Urquhart spouse of John Fraser, saddler Dingwall, Henrietta Urquhart spouse of Alexander MacKenzie Docherty , Alice Urquhart spouse of William Christy shoemaker, Dingwall, Une Urquhart wife of Simon MacDonald, smith,Kimmirdy, share and share alike -and to the ? heirs, executors and successors in case of the death of any of these my daughters before the demise of me or my said spouse. And I legate and bequeath to the said Christy Urquhart spouse of John Fraser saddler the small silver snuff box presently used by me which I received of my son Alexander’s effects and that over and above her share above mentioned. This I legate and bequeath to Alexander MacDonald my grandchild the son of the said Une Urquhart the silver watch I frequently wear and in respect my son John is well provided for by the annuity of 50 pounds sterling per annum left him by his brother which with his industry in his trade of cabinet maker ought to keep him comfortable during his lifetime and his being fir several years For is familated. He received all I can afford him. But I legate and bequeath the gold watch which I bought of my sons executors totally, my said son John’s eldest daughter and only child by his first marriage on her attaining the age of 15 years and failing of her by death to his oldest son by the second marriage when failing, the next son and failing sons to the oldest daughter of said marriage and that on their attaining the age of 15 years. when supposed unable to take these of being all expressedly prohibited from selling or disposing thereof but to take it as a family article in remembrance of him who originally had it. With full power to my said trustee to grant all necessary deeds or dispositions to purchasers continuing claims of a ? on me and my heirs. Declaring that my said trustees shall not be liable for confirms but cash only for his actual intro? In which land tenement and others are informed. I bind and oblige myself, my heirs and successors duly and validly to ? and seize the said trustees or the mansion and receptor of them and seal as they or other of them shall assume to not with them as Trustees for the ends and purposes herein before mentioned, and that by two several ? and unawareness of holding. One thereof to be holden of me and my heirs and successors in free Blanche for payment of a penny Scots money or the ground of said land at Whit Sunday yearly in the name of Blanch farmer if asked only - and the other aftersaid ? to be holden from as of said under our immediate lawful superior of the said land and tenement in the same manner and as freely in all respects as I hold or might hold, the same myself and further I hereby make and constitute my said trustees any lawful commissions and ? not only in and to the who write and ?, rights, titles and ? of said concerning the said land tenement and others above disposed and particularly in and to the aforesaid team contract and installment thereon in my farm with the whole clauses therein continue surrogating and substituting them in my full right and place of the premises. And I reserve full force to myself to alter and innovate these for ? in whole or in part as I shall think proper. Reserving also to me or the said Mrs. Anne McDonald the dispersing of a bequeathing to needy friends or relations such articles of bed clothes, table linen, or body clothes as the survivor of us see or feel inclined to legate and bequeath and that even on death bed, But declaring that the same so far is not revoked or altered by me shall be valid and effectual though found lying in my keeping, or that of any other confidential person I may instruct therewith. And I dispose with the delivery thereof and seal and hereby annul all former settlements or wills and I consent to the registration hereof in the books of council and open or other judges’ books competent therein to remain for preservation and to that effect constitute my procurators. And more over in or that my said trustees may be ? and seized in the heritable subjects and tenements and others above disposed hereby desire and require you…And such of you jointly and severally my bailers in that part hereby specially undiluted, that on sight hereof you pass to the same of the said land tenement and others and there give and deliver to the said trustees or survivors of them who shall accept, or such as they or either of them shall assume for the ends and purposes before mentioned heritable stock and sign, seal actual and corporal possession of all and whole the foresaid tenement and others lying and bounded as above described and here held as repeated ? cause, and that by delivery to the said trustees or their certain attorney or attorneys in their names ? hereof, of earth and stone of and for the ground of the said land and tenement and all other symbols usual and requisite and this in no ways of leave undone, for doing whereof theses presents shall be to you a sufficient amount, which to do I commit to you and each of you my bailers full power for this my receipt of saline directed to you for that effect. In witness whereof these presents note on this and the two preceding pages of stamped paper by William Young writer in Dingwall are submitted by me at Dingwall the fifth day of March 1842 before and in the presence of John Gengs writer in Dingwall, James Ross, clerk in the sheriff clerk’s office Dingwall, Alexander Urquhart, sheriff office Dingwall and Donald Cameron writer in Dingwall. The word “John” as per margin on the second page hereof and the word “Cameron” on the third page being written and signed before subscription of the above witnesses being witnesses thereto. Of the special desire of John Urquhart above designed, ho declared he cannot write, never having learned so to do. John Cameron and William Young,notaries public and ? in the premises do hereby subscribe for him, he having authorized me so to do by touching our pens in token thereof after the deed was read over and explained to him before and in presence of the witnesses above named and designed.
