A quick search on Google images, shows that picture, on Ancestry. I don't know anything else about it, as I don't go on that money-grabbing site.

about 15 trees have this picture. Once you post it to ancestry it enters the public domain.
It is my understanding that the photo was in the public domain before it was added to Ancestry.com due to it's age.  However I believe Ancestry.com's terms of use agreement states that their permission is required to copy any images from their Web pages (including their scans from the Federal census!, etc.)

I find it really disappointing that our society puts up with the fact that a terms of use agreement out weighs what constitutes public domain since it unnecessarily hinders the dissemination of knowledge.

I completely agree with you Peter.  A copyright that has expired due to public domain is not canceled out by a company's terms-of-use.

Just to be clear, this photo was NOT in the public domain before I posted it. I do have an original - and apparently so does someone named JoAnn Seline.  I would really have appreciated it if she had written to me on my profile and asked me about it.  I didn't see her message until well after she posted it here,  There is a strong chance we are related if we both have originals.  I also do not think it is fair to assume someone just pirated pictures without checking first.  I found the comments related to that a bit offensive since I do have an original.  Just saying....we should check with the person!
That comment assumes a lot.  I posted the original.  And I have an original photo.  If you are at all connected to the family, let me know.  Perhaps we are related.

Martha is a grandmother of mine. A copy was given to me by a cousin.

I have an original as well.   I did not get it off any other site.  Lillian was my grandmother Parnie's mother, so is my great grandmother.  This picture was taken after my great grandmother remarried to Mr Wilkison, and the little girl in the photo is my grandmother's little sister, Golda.

For some reason, I only saw the message yesterday.  Would love to connect and see how we are connected.
