Benjamin who m. Sara James and there are two more generations - back to John Roberts (John of Spots) who d. fall of 1724 in Culpeper County, VA. Notice that Benjamin's will gives property to his daughter
Jemima.

THIRD GENERATION
[264] BENJAMIN ROBERTS, JR. (Benjamin [4], John). Born in Culpeper County, Virginia, between 1734-40; married Sarah James; died in Culpeper in the fall of 1781.
Inherited 943 acres from his father.
He is probably the Benjamin Roberts, Jr., who was a Major of Culpeper Militia in the Revolutionary War.
Although he died in Culpeper County, he apparently lived at one time in Fauquier County as in an indenture made May 10, 1760, between his uncle George Roberts [3] and himself, he is called “Benjamin Roberts Jr. of the County of Fauquier and Hambleton Parish” (Culpeper County Deed Book C, pages 334-7).
His will, dated August 8, 1781, and probated December 17, 1781, is as follows:
In the name of God Amen I Benjamin Roberts of Culpeper County, being weak in my body but in my right mind take this Opportunity to make my last Will and Testament and first I leave my soul in the hands of God my Body to be Buryed in a Christian manner & Tis my Desire that all my Just debts should be paid First the rest of my estate to be left as follows viz
Item I give unto my sun Joseph Roberts one Negro Boy col’d Henry to him and his ars forever
Item I give unto my Daughter Elizabeth Roberts one Negro Gaill cold Eve the Daughter of Ginny to her and her ars forever
Item I give unto my sun Benjamin Roberts on Negro Boy cold Sam to his and his Heirs forever
Item I give unto my sun John Roberts one Negro Boy cold Adam to him and his hairs forever
Item I give unto my Daughter Jemima Roberts one Negro Gall cold Tiller to her and her Hairs forever.
Item I give unto my Daughter Sarah Roberts one Negro Gall cold Meleay to her and Hairs forever
Item I give unto my sun George Roberts one Negro Boy cold Billey to him and his Hairs forever
Item I give unto my Daughter Mary Roberts one Negro cold Chanty to her and her Hairs forever
Item as my wife is now Pregnant if a Daughter it is to have an equal Porsion as the Rest of my Daughters and if a sun to an equal Porsion with the Suns to come out of my estate not give to it and its Hairs forever
Item I leave all my Lands that I hold in Culpeper County to be equally Divided according to Quntity & Qullity among my Suns Joseph Roberts Benjamin Roberts John Roberts and the infant now in the Womb in case a sunto them and their Hairs forever.
Item I give unto my loveing wife Sarah Roberts the following Negroes Harry, Andrew, Mary, Rose, Ginney Eve six in all and all the stock and the household furniture during her life and then to be equally Divided among all my Children.
It is my Desire that my Brother Joseph Roberts & Daniel Field should Act as Executors of this my last will and Testament.

At a Court held in Culpeper county the 17 day of Dec. 1781,
This last Will and Testament of Benjamin Roberts Jr. dec’d was exhibited to the Court by the Executors and was partly proved by the Oath of one of the Witnesses and Ordered to be Certified. And at a Court held for the said County the 21 day of Jan. 1782 was fully proved by Another Witness thereto and ordered to be Recorded, And on the motion of the said Executors certificate is granted to them for obtaining a probate thereof in due form, they having made Oath thereto & given bond and Security According to Law.

The division of the Estates of Benjamin Roberts Sr. and Benjamin Roberts, Jr., were recorded April 15, 1793 (Culpeper County Virginia Will Book D, page 83).
Children: Joseph [270], Elizabeth [271], Benjamin [272], John [273], Jemima [274], Sarah [275], George [276], Mary [277] and Hannah [278].
