If a profile is marked as unlisted, is it still affected by the new GDPA?

Everything is under the new regulations. Once the person dies they can be changed to one of the more open categories.

Hi Richard/Ellen, if a profile is unlisted then yes it is governed by the GDPR legislation as are all living profiles. If what you are asking is weather you can edit or add info to your unlisted profiles, then the answer is yes you can. You can do absolutely anything with them because only you or anyone on your trusted list can see the profiles.

Shaun, since the GDPA came into affect quite a lot of my unlisted child profiles have been deleted, and so there for I can't do anything with them...
Yes Richard unfortunately that is correct, all profiles of children under 13 are deleted. It is best to keep them on a spreadsheet until they become of age.

It is still governed by WikiTree's terms of service and policies.

Since these were rewritten by a conservative reaction to GDPR, then you could say they are affected by GDPR.

Whether it is "governed by GDPR" or "under the new regulations" is questionable:

  1. GDPR only purports to regulate personal data of persons within the EU and EEA, and it has exceptions.
  2. it is still hypothetical whether GDPR would be either enforced or could be enforceable against WikiTree and similarly situated services.
