Will of Nicholas Allee.

I have a photocopy of this will from microfilm of the Montgomery County. records. In every case, including the copy of the signature, the name is. spelled ALLEE. For clarity on who Nicholas is or is not, please see the. chapter at the back of ALLEY ANCESTORS discussing Nicholas Allee of. Virginia.

Although there is scant proof, we ALLEE descendants believe him to be of. French Huguenot descent, and to be the son or grandson of yet another. Nicholas ALLEE. There is a very strong oral history in several. widespread branches of the ALLEE family of a French origin.

Also, a few of his descendants did use an ALLEY spelling, so if you're. an ALLEY looking at Nicholas ALLEE, you might actually be on the right. track.

It would seem that Nicholas made a particular effort to have his name spelled ALLEE. Charles Taylor, Clerk who signed the will, recorded a document in 1805 for Thomas Alley, Sr. spelling it ALLEY, which eliminates the possibility that he was in the habit of writing it one way or the other. In 1790, 91, 92 the Montgomery Co. Personal Property Tax Lists spell it ALLEE. ALLEE is also found in other Virginia records.

The Last Will and Testament of Nicholas ALLEE. 20 May, 1808, Montgomery County, Virginia. Will Book I, Page 347.

In the name of God Amen this twentieth day of May in the year one thousand eight hundred and eight. I Nicholas Allee of Montgomery County and State of Virginia being advanced in years and weak in body but of sound mind memory and understanding do see cause to make this my last will and testament that is to say I commend my soul to Almighty God and my body to the grave to be buried in a Christian like manner at the discretion of my wife and Exrs [sic] and as touching such worldly E?ldle? as it pleased God to bless me with in this life I dispose of the same in the following manner and form.

It is my will and I do ordain that all my lawful debts funeral expenses and Doctor charges if any there be shall be paid and lawfully discharged. I will and bequeath unto Mary Daughter of Joseph Denis deceased who is married to me and lives with me now as my wife and home keeper - Seven Cows and calves one Beef cow my mare that goes by the name of the young Roan and her choice three of the rest of my horses all my sheep and Hoogs [sic] all my Household furniture Beds and bedding her saddle and every other article thereunto belonging without exception all the grain Hay and fodder that is on my plantation G?owed and Growing the croppers part excepted at the time of my decease.

I also will unto the said Mary all the land that I now possess in this county during her natural life if she remains unmarried if she chusses [sic] to Live on it and if she will not chuse [sic] to live on it or should marry then the land to be sold by my Exrs [sic] for the most that can be got for it and the price thereof to be equally divided between my seven children by the said Mary namely Anne Nicholas Merry Betty Joseph Isaac and Hannah she drawing a childs part and I will unto the said Mary all or any Legacy or Legacies that has or shall fall to her from her fathers Estate.

I bequeath unto Thomas Denis that now lives with me one cow & calf. The ballance [sic] of my property is to be sold and the price thereof with my cash to pay the following? Legacy to my six children by my former wife to wit Sarah Stephens, Jemimah Hays, Keziah Robins, David, John & William Allee (commas added) Twenty pounds each and to Rhoda Cox my Grand daughter five pounds. If my negro Poll will find a man that will give fifty five pounds for her she may chuse [sic] her own master if not if any of my children will take her at the same they may the oldest having preference, and if they will not she shall be sold to the highest bider [sic].

And it is my will that if my children by my wife Mary should be like to suffer or not be well brought up they shall be bound out by my Exrs [sic] in such places and with such men as will be likely to bring them up in the fear of God & make them able to gain an honest living when of lawful age.

And if my wife Mary should die before the youngest of my children by her shall be of lawful age the two thirds of her dowry to go to my children by her and the one third is to be at her own disposal and whereas my son David Allee hath worked for me after he was of lawful age and my son William hath left property on my plantation for which they had no satisfaction in lieu thereof I will unto the sd [sic] David & William the Waggon [sic] they bought of me exclusive of the forementioned legacies. And it is my will that the balance of my property if any there be after the above legacy is paid the one half thereof go towards the Education of my children by the sd [sic] Mary and the other half to be divided equally between my six aforementioned oldest children.

My wearing apparel and my large Bible I will to my son David and I do nominate my ???? friend Peter Saunders Just? and John Long to be Exrs [sic] of this my last will and Testament as Witness whereof I set my hand and seal the day and date above written the words she drawing a childs part was underlind [sic] before it signed [sic].

At Montgomery July Court 1808. This last will and Testament of Nicholas Allee, deceased, was presented in Court and proven by the oath of Edward Gray, Junr. and John Long, the witnesses, thereto subscribed, and ordered to be recorded, and on the motion of Peter Saunders, Junr. and John Long, the Executors, therein named, who make oath and entered into bong with security according to law. Certificate is granted them for obtaining a probate thereof in due form. Teste: Charles Taylor, Clerk.

1767 Pittsylvania Co was established from Halifax, this included the area around Nicholas' Creek. This was probably the jurisdiction for the birthplace of some of the children of his first marriage. Franklin Co est 1785 from Pittsylvania.

was the Abraham Alez of Dallas Co AR in 1850 kin to this bunch?. see letters of David Lowry. Morton Alley in Overton Co TN 1801, to Marion Co TN early- see Marion TN records- but Alan has no record of Allee/y family in TN.

In the Montgomery Co VA Tax list for 1790,1791,1792, Nicholas Allee and John Allee are listed. Thus Nicholas Alley was not too far away from Thomas Alley in 1790-1792. In 1785 Nicholas, evidently having recently left Franklin Co. is recorded in Botetourt Co. Because, in 1785-88 most of his older children married in Franklin Co., which is farther away.

These marriage records indicate that Nicholas was living in Franklin Co. there before 1785, even though he owned a lot of land in Montgomery Co. where he died in 1808.

1770 Personal Property Tax Records of Botetourt Co. (probably the same as the later Montgomery Co. land). Lower District of New River : Moses, John & Samuel Kelsey- 1 Titheable each. Nicholas Allee 1 tihe-6slaves namely _ Eamy, Abram, Hanah, Cloe, London and. Absolam 23 cattle and 10 horses.

Henry County Wills, Will Book I (1779-1799), p. 129-30: Joseph Jones. Estate account. Payments made to John Rentfro, Thomas Brandon, Nicholas Alley and others. Approved 28 July 1786. Henry Co. is directly above Franklin Co.

(In 1790, 91, 92 Nicholas Allee and son John are listed in the Montgomery Co. Personal property Tax List. (Saw reference on web. Did not see the list.).

From the E. M. Richards book at the Historical Society she give the following as ancestors of Nicholas Allee, born 1735, father of David Allee:

Nicholas Allee, Sr., b. abt.1694. Jean de'Allee, b. abt 1670, France; d. in NY or NJ. States his wife,. Elizabeth Perdineau, b. abt 1672, France; d. 1719, NY. Nicholas de'Alle, b. abt 1640, France; d. abt 1700 prob. in NJ. States his wife, widow Tybout, b. abt. 1640, France; d. prob. abt. 1705, NJ.

I did not copy the documentation she had in the book. So I don't know how. she arrived at these names and dates.

However, if they were in the NY/NJ area as late as 1719, there is a good. chance of them still being there as late as 1726. So, maybe the marriage. record isn't such a stretch???.

I question Thomas Anthony Alley as his father as Thomas Anthony would have only been 13 years of age when Nicholas was born.

I have been conversing with a Frances Allee who states that the parentage of Nicholas is French not English and that the English lineage has been disproved via DNA testing. The lineage chart that he sent to me shows the father of Nicholas, b 1735 to be Nicholas Allee, b. 1694 and unknown mother. Parents of this Nicholas to be Jean de'Allee b 1670 in France and Elizabeth Perdineau, b 1672 in France. I would suggest some more research and sorting of this issue.

I agree. The gentleman you are referring to is actually James D Allee (his wife is Frances), and this Nicholas Allee is his and mine 6th GGF. James is in the E1A haplogroup and according to him all haplogroups related to this Nicholas Allee would need to start with E.

Allee-52 and Allee-15 appear to represent the same person because: Same birthdate; similar enough county of birth to be duplicated recordings.
