Death and Estate
The contemporary evidence we have for the death of Thomas Tarpley Bennett comes from the early court records of Jackson County, Georgia. He was dead by 2 July 1810 as an order was granted on that date by the Inferior Court appointing Thomas Hyde and Cornelius McCarty administrators for his estate.[3] The inventory of his estate was filed in court on 20 July 1810.[4] On 6 July 1812, one of the administrators, Cornelius McCarty, appeared in court and filed an annual return for the estate.[5]
In Sept 1817, the administrators of his estate petitioned to be dismissed and the for closure of the estate, all assets having been distributed.[6]
None of these probate records mention any heirs, and the administrators are not members of the family. One entry states that no one else appeared to oppose the appointment of these administrators who were not family members. The inventory also seems to indicate that no land was involved and all the property involved was personal property that might have been left behind when the family moved on further west in pursuit of land. These facts combined with the presence of several of his children in the early 1800's in south Mississippi and/or the Florida parishes of Louisiana along with a number of genealogies reporting that Thomas Tarpley Bennett died in either Mississippi or St. Tammany Parish, Louisiana about 1810, the possibility that he died in Mississippi or Louisiana cannot be excluded. This probate could have been an estate opened by unpaid creditors back in Georgia seeking to find any property that might be available to cover unpaid debts. All that can be said with certainty is that Thomas Tarpley Bennett was dead by 2 July 1810.
