At a surragates Court held for the County of tompkins at the Office of the County Judge of said County in the village of Ithaca on the 27th day of January 1848.
Present - Alfred Wells County Judge, Thamer Hallenbake Sole Executrix named in the last will & testament of Samuel Halenbake late of the town of Hector in said county deceased appeared for the purpose of proving and having the said will & the codicil thereto recorded according to law, and made satisfactory proof that a citation had been ____ according to law on the widow heirs & next of kin of the said deceased.
Francis Hallenbake, Alvah Hallenbake, & John Spaulding, three of the heirs of said testator appeared in person & by Elihu Ring Esq. their attorney to contest the proof of the Codicil to said will--An instrument purporting to be the last will & testament of Samuel Hallenbake deceased having the date the 25th day of June in the year 1846 was produced in court, also a codicil to said will dated the 4th day of July 1846 and shown to each of the persons _____ as witnesses and hereinafter mentioned -- which said Will & codicil are in the words & figures following to wit:
The last will & testament of Samuel Hallenbake of the town of Hector in the County of Tompkins and State of New York -- I Samuel Hallenbake considering the uncertainty of this mortal life and being of sound mind and memory (blessed be Almighty god for the same) do make & publish this my last will & testament in manner & form following (that is to say) first I give and bequeath unto my son Francis two acres of land to be taken from the east side of the farm on which I now reside and adjoining a piece of land I heretofore convey to the said Francis -- said Francis as (?) the line fence at his expense --
Item 2d-- I Give & bequeath unto my son Alpha three acres of land situated on my farm aforesaid to be in a square form and to include the house & garden which said Alpha has heretofore occupied, and the same that is now occupied by Byron Gregg. The said Alpha is to have and hold the same until Samuel Hallenbake the son of the said Alpha comes to the age of twenty one when the said Samuel is to have & to hold the said three acres forever--
Item 3d-- I hereby give and bequeath unto my beloved wife Thamar the remainder of my real estate consisting of about one hundred and four acres and a half of land together with all my personal property
Perhaps this Samuel Halenbeck is a grandfather of another Samuel Hallenbeck.
