Biography

Nancy Hanks was born the 5th of January, 1795, in Pittsylvania county, Virginia.

Nancy married John Fitzgerald on the 2nd of October, 1809, in Maury county, Tennessee.[1]

Nancy's husband John Fitzgerald died before May 1848, in Maury county, Tennessee. Nancy married her second husband David Dodson on the 26th May 1848 in Maury county, Tennessee.[3]

Nancy entered into the following deed of trust with Greenville Hanks prior to her marriage to David Dodson: "State of Tennessee Maury County} This Indenture made and entered into the 26th day of May in the year of our Lord eighteen hundred and forty eight, between Nancy Fitzgerald of the county of Maury and State of Tennessee of the one part and Greenville Hanks of the county & state aforesaid of the other part for and in consideration of the sum of five dollars to the said Greenville Hanks paid the said Nancy Fitzgerald hath this day bargained, sold and conveyed and do by these presents doth bargain, sale and convey to the said Greenville Hanks his heirs and assigns, all the right, title and interest in and to a certain tract or parcel of land, which is the one third of a tract of land formerly owned by John Fitzgerald deceased, it being the Dower of the said Nancy Fitzgerald, which is not as yet allotted and set apart to the said Nancy, the said land is lying and being on the North side of Duck River on the dividing ridge between the waters of Knob & Snow creeks and known as the place upon which the said John Fitzgerald resided prior to his death, and it being the place upon which the said Nancy now resides, which the said Nancy bind herself her heirs &c to warrant and defend to the said Greenville Hanks his heirs assigns &c against the claim or claims of any & all persons whatsoever during the natural life of the said Nancy. And for and in consideration of the further sum of five dollars to the said Greenville Hanks paid, the said Nancy hath bargained, sold and conveyed and do by these presents bargain sale & convey to the said Greenville Hanks his heirs & assigns all the right, title, claim and interest in and to the undivided interest of the said Nancy in to and belonging, and coming to her from the estate of the said John Fitzgerald dec'd to wit, all the negroes that may be allottted and set apart to her the said Nancy as the widow of the said John dec'd. Also all the stock cattle household and kitchen furniture, and all & every description of property whatsoever that may be or which has heretofore been laid off and set apart to the said Nancy (as widow aforesaid) which the said Nancy binds herself her heirs &c forever to warrant & defend to the said Greenville Hanks his heirs & assigns - But this deed is made for the following purpose to wit, the said Nancy Fitzgerald and one David Dodson have in contemplation a marriage, and in order to secure all the property that may be coming to the said Nancy from the estate of her late husband the said John Fitzgerald dec'd and all the property intended to be conveyed in the deed & is conveyed to the said Greenville Hanks for the use, benefit and trust for the said Nancy and her heirs at this time living; but no portion of said property in this deed conveyed is to go to any heir or heirs which may be begotten during coverture with the said David Dodson. And it is further agreed that the said David is not to have any control over any of the profits arising from the proceeds of the property in this deed conveyed And the said Greenville Hanks trustee &c is hereby authorised and directed to pay over to the said Nancy all the profits arising from the property conveyed to him in trust aforesaid for the use and benefit of the said Nancy & her children yearly or oftener as he may think best, or as he can dispose of the products &c. And it is further agreed that none of the said profits are to be liable for the payment of any debt that may be at this time outstanding against the said David Dodson or for any debt that may be contracted after coverture with the said David Dodson to all of which the said David gives his consent - Given under my hand and seal this 26th May 1848. [signed] Nancy her X mark Fitzgerald Attest. John J. Campbell, W.F. Southern I consent and agree to everything in the foregoing deed mentioned This 26th May 1848. [signed] D. Dodson Attest. W.F. Hanks-2717 and Hanks-1921 appear to represent the same person because: There two women have the same date and place of birth. Both women were married to David Dodson. Hanks-2717 has a more complete biography and sources that show she died after 1860. These are the same individual and should be merged.
