Biography

Elizabeth Hardin, likely the divorced wife of Mark, is found on the Prince William County Rent Rolls in 1753, 1754, and 1760.
In Nov 1753, Elizabeth sued Mark for alimony in the Prince William Courts. In 1757-58, she sued his brother John for property in John's hands in Frederick Co which belonged to Mark, Mark having left the county. Quite possibly this is the land left to Mark by his father's will.

27 Nov 1753 Motion of Marquis Calmes by William Ellzey his Atty as Trustee for Betty Harding on decree for Alimony against her husband Mark Harding who failing to comply with this Courts decree ordered that the said Harding be attach't to comply with the same.
The children here are speculative as no proof has been found, nor is there any further record of Mark. Is he the Mark Hardin found living next to Henry Hardin in Pittsylvania Co in the 1770's? That Mark Hardin's wife there is listed as Hannah in a deed in 1785. Henry also had a son named Mark who married a Mary and a Martha but apparently never had a wife Hannah. And Mark may have had a son Mark, as well.
I have also seen that Sinclair Hardin, supposed to be a nephew of Capt. William "Indian Bill" Hardin, was a son of Mark and Elizabeth Ashby. I have seen no proof.

[Notice that this Mark Hardin is married to a Hannah. The Hardin databases show Mark Hardin, son of Henry & Judith Lynch as married to a Mary and then a Martha, no Hannah. Mark Hardin, brother to Henry, divorced Elizabeth Ashby and disappeared from the records in Virginia.]

There is a will of a Mark Hardin in Randolph Co North Carolina which seems unlikely to be this man. I have seen it attributed to Mark Hardin who married a Hannah Holder. It is dated 28 Jul 1795 and was ordered recorded at the Randolph County Court May Term 1797. He did not mention his wife by name in the transcript online but he gave her bequests and appoint her executrix. He named daughters Anne, Setha, Susannah, Winifred, Letty, and Mary. He named a son Mark. Samuel York and Eli York were executors along with the wife. Not in the will, but Eli York was listed as the husband of the daughter Susannah. Son Mark said to have married Sarah York.
In 1850 in Randolph Co NC census, I did find Mark Harden, age 63, with wife Sarah age 65. He would have been only about age 10 at the time of his father's death in 1797, so I doubt that this Mark who died in 1797 in Randolph Co could have been the Mark who was divorced from Elizabeth Ashby in 1754.
The 1790, Randolph Co NC census does have a Mark and a Robert Hardin as heads of household.

Mark Hardin is an enigma. Although he is known to be the son of Mark Hardin (1681-1735) and Mary of Prince William County, Virginia. very few records of him exist that can be directly tied to him. He did receive land in his father's will but the later history of that land is murky at best. The last provable record of him is in 1760 in Frederick County, Virginia. He death date is unknown.

He is said to have married Elizabeth (Ashby) Hardin, daughter of Thomas Edward Ashby (1682-1752) and Rosanna (Berry) Ashby (abt.1682-1752). Circumstantial evidence tends to confirm this so she has been left as Mark's wife. However, several of the children attributed to him and Elizabeth (Ashby) Hardin (abt.1719-abt.1755) have been proven by Y-DNA evidence to be descended from William Harding (abt.1720-1798) of Stafford County, Virginia and therefore are not related to this family.

1734 16 March Will of Mark Hardin (1681-1735) Wife Mary, Eldest son John Hardin, 250 acres, Son Martin Hardin 200 acres, Son Mark Hardin 200 acres, son Henry Hardin 200 acres. Daughters Martha McDonhill Abigail, Mary, Ann, Alis, Elizabeth (100 acres). Proved 1 May 1735 All land in Prince William County.[1]

1753 27 November Hardin vs Hardin On the motion of Marquis Calmes by William Elzey his attorney as trustee for Betty Harding Elizabeth (Ashby) Hardin on a decree of alimony against her husband Mark Hardin who failing to comply with this Court’s decree ordered that the said Harding be attached to comply with the same.[2]

Frederick County, Virginia Records

1754 05 March Robert Ashby vs Mark Hardin In Case. This Case being agreed is ordered to be dismissed.[3] 1754 06 March Robert Ashby vs Mark Hardin In Trespass assault etc. This case being agreed is ordered to be dismissed.[4]

1754 05 September John Ashby attended five days as witness for Mark Hardin against John Hardin, ordered to be paid 120 pounds of tobacco.[5]

1757 06 April Book 7 Page 229 Elizabeth (Ashby) Hardin vs Mark Hardin, on attachment. John Hardin a garnishee in this cause being sworn declared that he had in his hands before the attachment was served[6]

1759 09 August Elizabeth (Ashby) Hardin vs John Hardin The witnesses being sworn and the arguments of the Parties heard and considered by the Court Ordered that the suit be dismissed and that the 0Dft pay Cost.[7]

1760 06 Aug: Book 9 Page 103 Robert Ashby vs Mark Hardin for trespass and Battery Discontinued two cases[8]
