John Hay, 2nd Lord Hay of Yester, was the son of John Hay and Elizabeth Cunningham[1] As Sir John Hay of Snaid (Dumfrieshire) he was sometime Sheriff Depute of Peeblesshire; he was knighted before 6 Nov 1498. He succeeded as the 2nd Lord Hay of Yester before October 1508.
John died at the Battle of Flodden on 9 Sep 1513.[2]
The Arms of Lord Hay of Yester given in the Armorial of Sir David Lyndsay of The Mount, Lord Lyon King of Arms, c1591, are Fraser of Oliver Castle quartering Giffard of Yester, with overall those of Hay of Locherworth. This arrangement is exactly as in a seal of Sir William Hay of 1420, the second Lord's great-grandfather; subsequent seals all confirm this.

THE SCOTS PEERAGE, ed. by Sir James Balfour Paul, Vol VIII, Edinburgh, 1906, pp. 432-4. has a nice write up on Hay-43, including: He married Elizabeth Crichton who was probably of the House of Sanquhar. She survived him, was living 1519, when the third lord made a grant of lands with consent of Elizabeth Crichton, his mother. They had issue: 1. John Hay-52 his successor 2. George of Oliver Castle 3. William Hay-3197 of Nether Menzion and Monktoun; ancestor of the Hays of Monktoun. His male line failed on the death of George Hay of Monktoun in 1643. 4. Mr. Thomas... 5. Elizabeth? Hay-886, married James Tweedie of Drummelzier and had issue. 6. Christian Hay-48, married to William Stewart of Traquair and had issue 7. Marion Hay-4610, married to Mr. George Broun, Colstoun co. Haddington. He died before Mar 15 Feb 1519-20 and she died in June 1564. The dowry of this lady is said to have been the famous 'Colstoun Pear', which according to a legend was enchanted by Sir Hugh Gifford of Yester of necromantic celebrity, in the middle of the thirteenth century. 8. Elizabeth, married William (Abernethy) fifth lord Saltoun. ...The will of Dame Elizabeth Hay, Lady Saltoun, was confirmed at Edinburgh 26 March 1576.

So while there is no doubt that Elizabeth married John Hay of Yester, etc., and given that usually only family members or the closest of friends witness charters (other than ecclesiastical officials), I suggest she is of the Creighton of Kirkpatrick family, not of Sanquhar, where there are no Johns or Jameses.

From the 1841 census I see Jane living with her parents: William and Margaret Middlemiss. Also with them is a Margaert Hay aged 91 (born c1750) who I suspect is Margaret the youngers mother. Margaret Hay was born out of county according to the 1841 census. Was she born in Scotland?
Looking at Tweedmouth marriages there was a marriage of a George Hay to a Margaret Nesbit on 31 Aug 1771 (familysearch says 1772). This Margaret could be the 91 year old Margaret in 1841. I wonder if our Hay's are connected? Any info you may have will be appreciated. Thanks so much!
