On 13th December 1431 a Supplication to the Pope was made for Archibald de Hebburn, layman, and Christian Heryng, "mulier", St.Andrew's diocese to be given permission to remain married despite being related in the third degree of consanguinity. Consent was given.[1] The editors suggest that this Archibald is "apparently" the son of Patrick Hepburn of Hailes who fought at Otterburn (1388). This is impossible. However his son Patrick had a son Archibald and it seems it must be him. The Hering (Heryng) family were from East Lothian, as were the Hepburns, and at this time a Gilbert Hering was the Vicar at Innerwick, near Dunbar, so very much Hepburn territory.
This Archibald Hepburn is mentioned in an indenture dated 4th January 1437 with his brothers William and Adam. He is also referred to as brother-german of Adam de Hepburn, Lord of Hailes, in a charter dated 12th March 1420 but not confirmed until 8th December 1440. He is named as uncle of Patrick Hepburn, Lord Hailes, in a charter by the latter to the monks of Coldingham, at Dunbar, on 25th November 1450. He may perhaps be identical with Archibald Hepburn, 'armiger' and burgess of Haddington, whose name appears frequently in the records from 1450 onwards, and who probably left a son of the same name."[2]
