He was probably born about 1494, the son of Sir Patrick Hepburn of Dunsyre and his second wife Lady Margaret. He was designate tutor-lawful and heir of Patrick, Earl of Bothwell, his nephew on 27 May 1515. He signed his name as 'Patrick, Master of Hailes' on that date.[2]

I didn't see where Nicholas was female.

Well, you'd better believe it!

Nicholas and Christian (and probably a few others) were names used in Scotland for females, though we now see them more frequently for males. Tricky!

Second spouse may be wrong? maybe it's Katherines second spouse?

It appears the wives are correct. I've added Scots Peerage links to verify.

Balfour-Paul says he married twice and cites a couple of documents, one of them her testament where her marital position (wife of, or relict of) would normally be given. I have not seen it.

Kind regards,

Gregory.
